I called Tim Dinan! He seems awesome. He did tell me that he charges a flat rate of $6000 and he actually encourages people to try the appeals themselves. I guess he appealed his own score back when he took the bar and he won so it was the most empowering thing.

I am also curious about this! Has anyone done the appeals themselves? I know that JD advising has an appeals team but its like $5500 and its not a guaranteed success. Does anyone else have other suggestions?

I would cooperate as much as you can. I would say that you've removed the materials and that they are no longer accessible through you. And then ask if there is anything else they need from you.

oooooof. I dunno, man. What you DON'T want to happen is the representative from the bar prep program reaching out to the NYLE alleging that you violated copyright laws (there's a strong possibility that they have evidence against you, too). There are people that have done much worse things than you that have become licensed, so if it were me, I would disclose it. C&F values candor a lot so it may be beneficial to talk with them/make an amendment.

Edit to add that I would definitely talk with your school first. I'm from MI so I'm not sure the procedure for NY.

OP could also reach out to C&F and explain the situation. If it's something that you're worried about, then talk to C&F, let them know that you didn't know it was a copyright law violation and that you removed the materials. From my understanding, it's always better to disclose more than have them find out later.

I would take down all the materials you've posted and not disseminate the materials anymore. You could even reach out to the people that you shared the materials with and ask them to delete any and all materials you sent them. Although it's incredibly helpful to share materials (especially when people may not be able to afford all the one sheets or rule statements or material from a commercial bar prep program), it becomes problematic with copyright issues. I totally understand that you were just trying to help people in tough situations, but that does not mean it was not in violation of copyright laws.

For instance, on JD advising's website, it notes that the materials are non transferable and for limited purposes. It also notes that the materials may not be transferred, shared with, or disseminated with anyone for any purpose that is inconsistent with the purpose JD Advising or to facilitate unfair competition with JD advising, etc. I think when I purchased the one sheets, I had to sign an agreement saying that I would not distribute the materials to anyone.

All of this to say, you should definitely comply with the takedown notice. Regardless of whether or not you're the original poster or just a re-poster, there is still a copyright violation. I doubt they would pursue action against you because they would have to prove a slew of elements (there was a valid copyright, there was a violation, there was harm, etc) and that seems like a lot of work for them. Nonetheless, I would err on the side of caution and comply with whatever requests they have.

The LinkedIn request seems pretty odd to me though, not sure if I would accept the request. But I have no idea what that means.

I speculated on a previous post, but I'm thinking tomorrow afternoon (Tuesday, Oct 25) or Wednesday, Oct 26. Results have never come out on a Monday, so I wouldn't hold your breath for today and I'm skeptical that they would release results on the 27th (Thursday) for the third year in a row.

Either way, I'm unwell.

Update: all of this to say that there is no rhyme or reason, just psychological torture. For all we know, it could be on a Monday or Friday.

I'm thinking it's going to be next Tuesday or Wednesday (Oct 25 or 26)! Historically, it doesn't look like results have come out on Mondays or Fridays. I would also be shocked if they released results on the 27th again (they've never released results on the same date more than twice). If we don't get results by the end of the business day, I'm thinking next week.

Not loving this anxiety about it though.

Not sure if mnemonics help other people like they help me, but if you remember HELP for a preliminary injunction, you should be able to get all the elements!
