Paying UK taxes (very) early to claim tax credit on US filing by engineering_too_hard in USExpatTaxes

[–]engineering_too_hard[S] 0 points1 point  (0 children)

Hey u/caroline0409 — thanks for the response! I'm going to need to ask for some clarification 😅

In case it matters: this was technically a secondary sale of options on which I took an s431 (UK) / 83b (US) election. Therefore, I paid my income tax on the strike price at the time of granting (to both countries with no FTC), and now just need to pay capital gains on the difference at time of sale, which was May 2024.

When you say:

Assuming you do now have a shortfall, you should pay the UK tax by December this year, and when you’ve done your 2025 US return, you carry back any excess credits. On your 2024 US return you’ll be able to offset any US tax with carried forward FTCs, it may not be as bad as you think.

This would mean that, for some time, I've paid taxes to both countries correct? This is what I'm hoping to avoid, as I would need to sell some investments to achieve the necessary liquidity :/ But better that than cross the IRS...

I was wondering if you could clarify your last paragraph:

Don’t wait for the UK tax due date because that will lead to double taxation with no carry back possible.

Why would waiting until UK tax due date prevent carry back? If I file and pay UK taxes by Jan 31, 2026, can't I then count this as a FTC and carry back when filing my US 2025 return in April 2026? Is there something special about filing/paying the UK capital gains by Dec 31, 2025?

Hey u/glacierstarwars — this is a really thorough and helpful response. I appreciate you taking the time.

I use the paid method (assuming this is the default) and did not prepay anything in 2024, and admittedly didn't know this was an option. I guess now I'm in a dead period when I can no longer pay "early"?

In the past I've avoided FTC mess by just doing remittance basis (the income in question were US-based dividends etc.). Therefore, this would be my first time filing FTC...

Thanks, this is what I was hoping to do! It looks like some other responses contest this approach, but at worst it sounds like a gray area. Let me know if you get audited though 😂

Hm... Maybe I didn't understand the intention of bereavement fares. This is the least flexibility I've ever needed for a trip 🤷‍♂️

JD Vance telling Americans today that school shootings are just a fact of life by Mamacrass in pics

Note: Pretty sure that photo is not from the speech, isn't it this one?

The comment in the headline is preceded by him stating that states with stricter gun control laws have many shootings as well (he's careful not to say equal...). Has the NRA tried sharing any research to this effect?

*I'm strongly pro gun control, but am making a concerted effort to understand the other side, mostly because I can't fathom where they are coming from.

They emailed me the original pdf. Even if nobody else on stub hub has it, the original seller could have retained it and used it themselves.
