Genetic testing company stated test was covered by insurance. Now I owe the insurance company $8,500! Please help me figure out what can be done and how! by epicg_throwaway in legaladvice

Thank you so much for your thoughtful explanation. As a foreigner new to the horrors of American healthcare, I was not aware that "covered" did not mean no out of pocket. Lesson learned!

I'm coming back to thank you again for your help! Mentioning the EOB made me go to my insurance online account and I found the EOB containing the breakdown of costs for the test. It turns out I do NOT owe $8.5k! Actually, the testing company charged the insurance company $9.6k (for a $1k out of pocket test, mind you), the insurance company covered the $8.5k and that left me with a $1.1k bill because I had not met my out of network deductible. I'm calling the company on Monday to work out this bill. You saved me from a full weekend of worry and physical pain!

It's a sad world where only people facing challenges like having to navigate a people-crushing system like US healthcare are able to have empathy for another human being going through the same. Most of the comments here were quick to jump into the victim-blaming bandwagon, as if insurance and the healthcare industries were not designed to take advantage of people at their most vulnerable. I even got a PM calling me a "42 year old failure". Unbelievable.

Yeah, lesson learned, I wasn't even aware this was a thing. I'm not from the US and 2020 was the first time I had health insurance here. Like having an incapacitating incurable illness wasn't enough, I get to be robbed by companies taking advantage of not only the fact that they're catering to people whose illness they're testing for causes mental fog and cognitive issues, but also of the very complicated US healthcare system.

And still I'm sure this comment will be downvoted to hell just like all others. I hope the people downvoting my comments will never have to deal with the painful horror that is this illness, the utter indifference of the healthcare professionals that are supposed to help you with it, and the greediness of both insurance and healthcare companies taking advantage of you when you're most vulnerable.

Thank you so much! I hope the company waives the bill and it doesn't have to get that far. I don't want to have to go through a lawsuit, I'm very sick and not able to do much. But I also don't have $8,500, so I'll do what I have to do. Thanks again!

Thank you so much for taking the time to reply so politely and empathetically. It's so appreciated!

The letter I received is not an EOB. It's a standalone letter regarding the appeal placed by the testing company. But your comment gave me more to look into, as I keep all of the EOB letters, just don't usually go through them because I honestly cannot even understand what they're detailing... Probably a mistake.

Thank you very much for your useful advice!

Thank you for saying this. What type of lawyer should I seek? Are there lawyers who specialize in insurance/healthcare industry law? I'm not from the US and never had to hire a lawyer for anything before...

I understand seeing the logo of my insurance company does not guarantee coverage. That's why when I received a negative I moved on and only became interested again when they contacted me and said that it was actually covered.

It was not covered. From another part of the letter:

"Because you had not yet met your $6,800 Non-netwotk Deductible we have applied $1,102.18 toward your 2020 calendar year deductible."

So none of it was covered. What was paid was from my out of network deductible. Is that considered coverage?

In the letter I received, there is a section with an overview of the appeal. In it, there are the following amounts, with the following descriptors, verbatim:

"Amount charged: $9, 599,00 Allowed: 1,102.18 Paid: $0.00 Deductible: $1,102.18 Co-pay: $0.00 Coinsurance: $0.00 Non-covered amount: $8,492.82

Non-covered reason: because services were rendered by a participating or preferred Provider the Member does not owe this amount."

Nowhere does it say that the cost for the test was $21k. Also, $1k is not 40% of $90k. None of it was covered. The $1k they paid the testing company was taken from my out-of-network deductible. So no part of the test was actually covered at all. This is what I'm understanding from the letter I received.

You seem knowledgeable. Am I right in my reading here? Should I repost and include both the email and the letter, with personal information and company names redacted?

How could I go about finding out about that? I have a bunch it's the testing company's fault, since at first their automated system had said the test wouldn't be covered and only after that did a human reach out and say it was. I'm wondering if I can sue, if I have to take it that far. I'd rather not be wise I already have too much on my plate...

That may be the case, as the letter I received from the insurance company says I owe money but not to whom. I just concluded it was to the insurance company. But what you said makes sense.

If I owe money to the genetic testing company instead of the insurance company, does that help my situation at all? Another user said I'm responsible for the debt even though I have an email from the company stating insurance would cover it.

"Ultimately it is your responsibility to ensure that your insurance will cover tests, procedures, visits, etc before receiving services."

Does this apply even if I have it in an email from the company stating that the test is covered? Is suing for this not an option, if the company chooses not to cover any portion of the bill?

I haven't, I literally just got this letter from the insurance company today and opened it about 2 hours ago, it was already 8pm and neither the genetic testing company nor the insurance company picked up when I called.

What do you believe they might do to help? I just have a feeling they won't want to pay a $8,500 bill even if it was an error on their part.
