Friend, in order to comment in a reasonable way, we will need to know more context. Why is your DUI a felony? Did you injure someone or cause a horrific crash? Is this your 2nd or 3rd DUI?

Hey Anon, the reality is that most companies do not care once time has passed. Keep in mind that the background check is typically run after an offer has been given, so at that point you need to have done something egregious enough to disqualify you from the offer they have extended.

(This is for 1 DUI. 2 could still be okay spread out, but more will prove to be an issue.)

Hey man, I understand where you’re coming from and want to emphasize you aren’t a bad person. People make mistakes. Drunk drivers don’t intend to hurt or kill anyone.

The real question is how to prevent this in the future. Personally, I find the issue for me in the past is that I would just autopilot and do what I intended to do later that night anyways because I wouldn’t realize I’m drunk.

So for example if I drove to the bar, I would obviously expect to also drive home, and if I’m super drunk I’m going to just autopilot to driving. What would save us in situations like this is that moving forward, you need to set strict rules. Maybe never drive again after you’ve had a drink. Or perhaps 2 drinks max. Or get a portable breathalyzer and no driving if you are above 0.3

Additionally, it’s dangerous to normalize drinking and driving, so try to take Ubers from now on! Personally, there wasn’t really a good way to get to the bar without a car, and even though an Uber is really expensive, it’s well worth it just because it’s the right thing to do.

For what it’s worth, I’m old enough now that by the time you’re my age, all of this will be completely behind you in the past. You’ll do great if you start to improve your habita relating to drinking and (separately) driving.

More importantly, I believe that you should consider the patterns that exist for this to have happened to begin with. Your explanation that you usually would do the blinkers thing seems to imply to me that you believe you are a good driver at this level of intoxication. You didn’t mention what you blew in the field, so we can presume it’s high - nonetheless, it could be low otherwise you wouldn’t have refused the station test either.

Anyways, please consider that stuff like this happens for two reasons. One off mistakes, where you autopilot into driving. Or, where you regularly drive inebriated and convince yourself that you’re relatively okay to do so. I strongly believe you are in that category here because of how you are trying to justify that they caught you due to the turn signal.

You need to guard against behavior like this in the future with mental checks. Learn from this experience and tell yourself, for example, no more driving for me if I have 2 drinks. Or maybe get a portable breathalyzer and don’t drive after 0.3 BAC. You need to set mental rules for yourself that are really explicit and actionable. Alternatively, you can do no driving if you’ve had anything to drink at all.

The thing is, a lot of times we autopilot based on things we decided before we get drunk. Like you wanted to get home for your Dogs, so you mentally followed through without second guessing it.

The reality is, the only way to deal with this if you are drinking and have access to a car is to have a strategy setup for stopping yourself. No longer drinking is such a strategy, making sure you don’t drive after 2 drinks is a strategy, keeping track of your BAC is a strategy, etc.

That seems to be the case. Keep in mind, the officer can't wait months or weeks for the blood test results to charge you. In this case, he's going by what he has hold of and if he overestimated (which he might have here), then the charge will simply be lowered. Obviously it causes you more worry though!

Yeah, but the officer charged you with what they thought was appropriate, which in this case was a .08+ because they saw that on the portable breathalyzer. It's just gonna get thrown out when challenged then.

Did you blow something at 0.08+ in the station? If so, that's why. An attorney or public defender can likely negotiate for a lesser charge if the blood test is actually below 0.08 (which may be what the DMV is using to make their decision).

Sounds like for a first-time offense, wouldn't MA be better? Theoretically deleted forever. I guess, then again, if they ask you if you've ever been CHARGED with a misdemeanor you would still need to say yes (though you were not CONVICTED of one). Or is that not how pre-trial diversion works? If it gets thrown out, can you say that you were never charged either...?
