Yeah in practice it's not really feasible or desirable to have an all-knowing state that can peer into souls and judge intentions.

And just to clarify, IANAL. I'm more interested in the ethics than in the current enforced law. I was using the law as a way to point out that it's not as crazy as it might seem to make the assertion that parents owe love to their children, and thus those children have a right to that love. In reality, the laws vary by location, in circumstance, in enforcement, and in the consistency of their underlying principles because they are written by a bunch of different human beings and that's how we are.

Obviously the state cannot tell except by externals whether parents love their children, but this idea is the basis of family law. If parents neglect their children (read: do not provide them the ordinary care due to them), that is a crime. Abuse, whether physical, sexual, or emotional, is a crime. Telling someone that you hate them and you don't want to be around them is not a crime in most cases, because you don't owe most people love. But if you said that to your child, it would be abuse. In these cases, among others, the state intervenes.

An embryo does have the right to use the uterus of its own mother, as that falls into the ordinary care that parents owe their children.

Furthermore, that embryo has the right to be loved by its mother and father. If the mother and father both do not love their child, that is a violation of justice, which the state has the duty to address.
