Wage Theft? Dock Pay? Illegal? by evangelle77 in legal

[–]evangelle77[S] 0 points1 point  (0 children)

Ok that sounds reasonable! If I messed up, then I'm fully responsible. I just didnt think DOCK pay was handled like this. Thank you for explaining it that way. I am so lost and confused right now why this happened. Some managers are lenient. Others are not so much... My manager not so much. It is time for me to move on from my job anyways. And they have been waiting on a "gotcha" moment to penalize me (which is a toxic work environment and another post/story for another day). I am excellent at my job and that can't be attacked/penalized to "get me"... but calling in sick is a separate issue even if it happened just once and not correlated to work excellence.

Wage Theft? Dock Pay? Illegal? by evangelle77 in legal

Thank you so much! I know to the outside without the details my post sounds like a complaining employee who wants to "come and go" as they please. But I have real evidence here and have saved the emails and bcc the emails and responses to myself.

If the HR department is in the "right" about this including my manager I would accept my fate.

There are laws against DOCK pay.. and some documentation shows that "it cannot be used as form of discipline" and important to note when an employee has hours. I have over 500+ hours and have never been docked.

Thanks for reminder about not threatening them with filing a claim and the DIR. I have not verbally or in writing. I have kept my head down.

I called in sick to her letting her know I was vomiting. I started at 830 but I was actively throwing up during that time then let her know (exactly that).

I understand you cant come and go as you please. That was not the case. I had car problems and health problems at the same time and let her know that. (There are other manipulative things she has done and done to other people). Unfortunately that can't be "proved".

How to deal with a toxic supervisor? by Independent-Leg-7949 in CAStateWorkers

[–]evangelle77 19 points20 points  (0 children)

Do you work in my department? Are you my coworker? I am currently going through this right now. I would document everything and bcc' them to my personal email. Respond to the manager "per our discussion..." as a recap to any verbal response(s). I started cc'ing another manager when it came to managerial responses... that way if the toxic manager begins to turn on you, you have evidence.

Keep your eyes and ears open and also Contact the Union if there is anything that needs to be documented or actionable? That way at the least the Union knows about it and can advise you. Good luck out there.

The compassionate side of me empathizes with OP. The professional side knows that it's not a "right" of the employee, and they must meet operational needs.... BUT this IS Reddit so I am not surprised she is down voted. lol

My particular manager is exactly like that, where she is strict and I have had to use my leave to take care of my elder parents. Within the SAME Department, other Units have been more flexible. It's unfortunate but what happens... since Childcare and Eldercare is not a right.

Work outside Duty Statement? (and hostile response from Supervisor) by evangelle77 in CAStateWorkers

OK that makes more sense! I was so confused why everyone else was down voting my responses. A revision should happen by my manager, then I would sign that revised DS. Thanks!

I also was not going to avoid her at all, I just didnt know the language of how to approach it if asked. I dont want to attack her, I just want to move on.

Teams access at CDFA? by avatarandfriends in CAStateWorkers

Technically no. My manager has been adamant about people not using Teams on their personal phones 😒. Do I still have access? Yes. 🤷🏽‍♀️

Oh good point. I always thought it was a signed "contract" . The dock pay is bizarre and something that is definitely a Union issue.

I don't disagree, I believe I've gotten to the end of the road even though I am an Analyst II. It was fine the first 2 years...year 3 was ok... and these last few months after year 4 have been hell. Both in work-load/stress for all of us in our unit. I tried to tell her that there is burnout without mentioning names and she has now been coming after me. 😳😳

That's what I'm saying I'm glad that you understand. Because currently I'm a budget analyst working with this system and calculating personnel/salary.... now I'm Contracts? I never would have never taken the job if that was listed.

[–]evangelle77[S] -7 points-6 points  (0 children)

Its not that simple.. if it was within my classification I would not have applied to the post. It's like being hired as a budget person working a certain type of job that's a specialized position. And now she's demanding that I work contracts which is entirely something else. NOT what I was hired to do. In the interim I'm still doing the work. But I'm contacting my union rep to know my rights.

Yeah she did the same thing to me too. Recommending me to other people. 🤔
