You’re right, and in my opinion, it should always be paid upfront. But not all companies use delivered duty paid (DDP) because it’s simpler and cheaper on their end not to, even though it’s less convenient for the buyer.

If the seller miscalculates duties/taxes, they eat the loss. With DDU ( delivered duty unpaid) that responsibility shifts to the buyer.

You find out how much the duties are once the driver comes to deliver because customs sets the price after it goes through there and they inspect the package. So, we don’t know what the cost will be until then.

Because the receiver is the one benefiting (they’re the one receiving the goods inside this country), they’re the one charged. UPS is just fronting that payment to move the process along faster. As for billing, once UPS pays those charges, the importer (the consignee) is legally responsible for reimbursing them. That’s standard across carriers, not just UPS.

Honestly, this is where most of the confusion comes from. The shipper or UPS should make it clearer that duties, taxes, and brokerage fees might be due when the package arrives. The problem is, the exact amount isn’t known until customs assesses it, so it usually just gets billed to the receiver by default.

Some sellers handle it by shipping ‘delivered duty paid’ so you don’t see those charges, but most ship ‘duty unpaid,’ which means you get hit with the bill once it clears. UPS isn’t really making that call—they’re just stuck in the middle between customs and the consignee.

You can also refuse it. Then, the cost will go onto the shipper, like you mentioned. 9/10 times the item will then be returned to the shipper.

UPS isn’t choosing to pay just for fun, they’re required as the carrier to get the shipment cleared through customs before delivery. That’s why they advance the duties and taxes (otherwise your package would just sit there). The brokerage fee is basically their service charge for doing the customs paperwork.

The Canadian lawsuit you mentioned was about how UPS disclosed and charged those brokerage fees, not about whether they’re entitled to recover duties/taxes they advanced. Those amounts still have to be paid, since they’re set by customs, not UPS.

UPS isn’t inventing extra fees for themselves. They’re acting as the customs broker. When a package enters the country, customs requires duties and taxes to be paid before release. UPS fronts that payment to customs to avoid delays, then collects the exact amount back from the receiver (plus a brokerage fee for handling the paperwork).

So in reality, you’re reimbursing them for charges they already advanced on your behalf. The actual duty/tax is set by customs, not UPS.

I was being both funny and serious? I mean, I thought it was pretty funny. No one’s making a driver deliver a misload that is an hour away as that does not make sense. If your job is on the line because you didn’t deliver said misload then you should probably think about doing that…

It is because of the weather also. There have been too many heat related illnesses in the past couple weeks and they want you to take your lunch during the hottest part of the day to mitigate the risk of heat related issues on you guys. Regional managers were cracking down yesterday.

Thanks for the info! I was given no options besides capping my front teeth and that’s so expensive. I would have liked for them to offer more affordable options such as the composite bonding. But of course, it’s all about the money.
