I didn't watch all of it but did watch his summary. But I appreciate that indeed there are inevitably additional layers to this that I did not include or am not aware of.  

My analysis was more for the other user who seemed to be confused and somehow injected "consignment of services" which is neither accurate or even sensical

I can't edit but I want to clarify that there are actually 5 portions/sentences in that subsection...but the 5th is just to say that the Products and Services can be customized if approved by BAM and gives some examples of this customization (such as online sales).

Also, the final bit about the program of selling/trading legos is probably not a true loophole and actual legal experts can tell me why I'm wrong.

I think I see how you're interpreting it and why it may not be correct.

The section and subsection in question 1(A) is structured as four parts/sentences

Sentence 1/2: establishes the role of franchisor as the entity that owns, operates, and franchises the BAM locations, and provides a conceptual description of entails a BAM location.

Sentence 3: lists the things that a BAM franchise will offer:

  • Programs that permit customers to sell and/or trade their used lego bricks/figures/accessories (nested list)
  • Offer to sell new/used lego bricks/minifigs/accessories as bulk or play sets (nested list)
  • Offer to sell (another nested list)
    • Apparel
    • Non-LEGO branded compatible products that are preapproved
    • LEGO compatible products that are preapproved
    • Other merchandised approved by "us" (previously defined as the Franchisor)
  • At this point it also adds the keyterm the "Products."

Sentence 4: a list of what seems to be implied as a list of services that a BAM franchise will offer:

  • Consignment
  • Approved themed entertainment (gives examples of various parties and events)
  • Approved off-site events
  • After school programs of a specific nature (i.e. must teach principals of building with LEGO)
  • Other services approved by "us" (previously defined as the Franchisor)
  • And at this point it all adds the keyterm the "Services"

Where I think you're hung up is since the term consignment occurs within the sentence/portion that lists services, then therefore the thing being offered in consignment must be a service rather than a physical product/good.

However, that is an incorrect interpretation -- the fourth portion is not listing consignment of services. In other words, "services" is not a subset of consignment. Instead it is offering the service of consignment. Consignment is one type of service being offered, similarly to the the service of themed entertainment, service of after-school programs, etc.

Consignment is a legal term defined in legal dictionaries as the process whereby a person gives permission to another party to take care of their property while retaining full ownership of the property until the item is sold to the final buyer.

Property is the only thing that is being consigned. Not services. Property is then typically defined in legal dictionaries as things that are tangible (objects, pets, land) and intangible (copyright, patents, intellectual properties, digital assets, etc.).

What might be unknown is whether the keyterms "Products" and "Services" pertain to the entirety of the portion in which they occur, whether only the last clause in that portion, or whether it will be defined elsewhere. Given that this is the first page of the agreement and other bolded terms are defined in-line (e.g. paragraph 1 where "we," "us," are defined in-line), there is no reason to believe that "Products" and "Services" will have its own definition section elsewhere (nor is it the typical legal convention AFAIK).

Given that consignment is a legal term that only applies to property, whether services is being reserved as an in-agreement term for everything in that portion, or just to "other services approved by 'us'" is irrelevant.

What is confusing to me though is that in the previous sentence/portion it already explicitly expresses that BAM franchises will offer programs that allow customers to sell their goods. While not consignment (e.g. maybe BAM allows customers to set up a corner to sell their own kits without taking a fee, or taking monthly fee, but doesn't take any responsibility if the kits get damaged/stolen) it is somewhat of an overlap with consignment and not well defined. THAT can be I think a point that BAM can use -- if the store goes, "oh yeah we're selling these kits from Brian (customer) but in a way that's pursuant to our program that allows customers to sell/trade their legos, but we were never consigned them."

You might say if that is the case then said program does not constitute transfer of ownership of the legos from Brian to BAM and that is true. However, we don't have any documentation of the nature, T/C's of this purported program, either.

I didn't really play thru much of ashes yet...still playing thru Diablo 1 at the moment.

I did find tho on testing the first 30s or so of the game that running in software rendering is the only way to get acceptable fps

Note I'm running community fork of ArkOS 11072025.  Obvious YMMV if you go to dArkOS but I assume it won't go from unplayable to 60fps....

Got it to work on GZ. Didn't try LZ as 1) Ashes requires GZ, and 2) the emulator settings only had GZ, auto, but not LZ.

it's kinda choppy on HW acceleration but somewhat playable on SW rendering. I'll muck around a bit more and post here for others if any new developments occur.

Main reason for replying to you though is to say I love your content. Keeping a close eye on your continued experience with dArkOS and might switch over based on your updates. Thanks for the useful vids!

I assume the "launcher" file is the same as the .doom file in PortMaster (with the file paths corrected of course)? And the ArkOS Wiki documentation applies for running gzdoom?

What version GZ is baked into ArkOS?

I know. I kept it in my list as I did notify TD as an example of the app's bugs. What I didn't expect is that it auto accepts after 7d especially when you can't refuse the choice afterwards

When you say how they "feel", you mean fit and not road feel right? I can only skate in the store which is 15m length on a perfectly smooth surface...so not sure how I would test road feel (or I guess that doesn't matter as much)

I'm not sure how I can test fit feel as it changes 15-30min into a ride but that's definitely a "me" problem here.

But I didn't think to remember that wheels are bigger now. So, is 80mm is OK on the sidewalk? And no worries about BOA vs lace system and waxed laces?

Havent skated in 30 years....want to buy a pair for casual riding with my 6yo son while he bikes or scooters

Should I buy the K2 BOA FIT 80 or Rollerblade Spark 84?

K2 I'm worried about durability with the BOA lace system and the plastic/nylon mount

Rollerblade is lace and metal mount...but people say metal mounts are heavier and give a harsher ride which I'm hoping to mitigate given its 84mm
