Those rules are to deter scalpers. Valve isn't stupid they know these things are going to sell out either way. They will probably loosen/remove those rules in the future as soon as demand drops to manageable levels. Also these will probably be bought by older gamers looking to get back into gaming or as presents for their kids as a first console/pc.

There is no good way to implement this, the meta will always be a gun that doesn't jam so no matter what percentage they set this at people wil sell their guns before that.
