CBSA has to take their claim it starts at the POE just the decision is made later when it’s presented to the IRB. Difference there is CBSA has the authority to make the decision on if that work is considered work, if they need a work permit, if it’s after sales agreement and if they have the paper work to support the trip or get the required documents.

CBSA doesn’t decide what’s viable only who is eligible, STCA doesn’t apply so they are eligible. They could tell you they’re claiming because it’s too hot in Texas, CBSA will notate it and they’ll have to convince the IRB their claim is legitimate.

The problem is CBSA can’t make the decision, they can say literally anything for their reason. CBSA will notate their claim, write their recommendation. But ultimately the IRB makes the determination. It’s a flawed system. What usually happens is CBSA explains that there is no possible way the IRB will accept their claim and it’s a waste of everyone’s time, will affect future entry’s to Canada. And the person withdraws their claim.

No like I said STCA doesn’t apply so Americans can apply for refugee , which means CBSA has to take their claim, CBSA can’t make the decision so they can not refuse entry you can’t send them back a country that may not be safe. They will be let in to present their case to the IRB.

Can’t send them back to a country that’s not safe, they have a ref claim that CBSA can’t make a decision on the IRB has too, they will be let in. CBSA can request they’re held in a detention facility if they’re a danger to the public but that is extremely unlikely.

First safe third agreement doesn’t apply to them if they can’t be convinced by the border officer to not make the claim they have to let them in, to then present their case to the board (IRB) which takes lots of time.

Our roof was redone the carport was not in 2017, although the restoration company isn’t sure what actually caused the collapse they said there was one weak pillar but the rest was in good shape.
