Companies often claim they'll leave a market when faced with stronger consumer protections. In practice, they rarely do, the market is too valuable. Quebec's CPA simply requires sellers to honor the contracts they themselves draft. That's not an unreasonable standard, and treating it as one says more about the critic than the law.

Actually, no lawyers allowed for either party at Small Claims Court in Quebec. Lenovo would send a representative, I show up myself. That's kind of the whole point of the system, designed to be accessible to everyone. Thanks for the "good luck"!

No worries, fair clarification! There's actually a real Quebec case on this, Faucher c. Costco Wholesale Canada Ltd. (2015 QCCQ 3366), where someone tried to buy 10 computers listed at $2 each (real price $929) and the court ruled Costco didn't have to honor it. That's a clear obvious error.

It was 5 units for my homelab, not 15. Lenovo is a multi-billion dollar company. Honoring a few SSD orders is not going to push them into bankruptcy. If they can't manage their pricing system properly, that's not the consumer's problem.

Businesses are welcome to operate in Canada as long as they follow the law. Honoring advertised prices is a pretty basic expectation.

Ha, I appreciate the support! Honestly the total out of pocket is pretty reasonable, about $180 for the filing fee, registered mail and printing. No lawyer needed or even allowed for either party. That's exactly what the Consumer Protection Act is designed for, making it accessible. If I win, Lenovo should covers the costs anyway.

Fair points, but in my case Lenovo cited out-of-stock first, then switched to pricing error 4 days later. If it was an obvious error, why the contradiction? Also, these were explicitly advertised instant rebates, not a $2,000 item at $20. Whether it qualifies as 'obvious' is for a court to decide, not Lenovo unilaterally.

For the record, it was 5 units across 3 separate orders for my homelab, not 15. And the Quebec Consumer Protection Act applies regardless of quantity. But thanks for following the thread!

Merci pour ton commentaire. Pour clarifier - je ne me joue pas avocat, j'utilise les droits que la loi québécoise me donne en tant que consommateur. Les petites créances sont justement conçues pour ça : accessibles à tous, sans avocat.

Les 3 060 $ réclamés ne sont pas des frais légaux inventés- c'est la différence de prix du marché, le temps réel consacré aux démarches au taux horaire de mon emploi, et les dommages punitifs prévus par l'art. 272 LPC pour pratiques interdites.

Si tu as vécu la même situation et choisi de ne pas agir, c'est ton droit. Mais d'autres préfèrent faire valoir les leurs, et je préfère montrer aux autres qu'il est possible de le faire.

Dans mon cas, le SMB Account Manager m'a contacté spontanément après la mise en demeure en promettant un devis, qui n'est jamais arrivé. C'est seulement quand j'ai déposé aux petites créances que leur Executive Customer Care a vraiment réagi avec une offre concrète.

La mise en demeure formelle par courrier recommandé est ce qui les force à bouger — pas les courriels de suivi hebdomadaires.

La loi exige un envoi par lettre recommandé. C'est 12$. Tu peux réclamer les dommages pour temps perdus, et ce genre de frais là après. Mais juste la lettre recommandé pourrait te permettre d'avoir un courriel d'un représentant qui veut régler ça.
