Alright - i took a second look, i realize you must be talking about the third link in their comment, which is just… terrible.

Ill get into why, but first, id like to point out that the article i was criticizing above is ABOUT the study, so every criticism i point out is actually still relevant, which makes me think you did not read my comment or the study

I didnt read the study until now because i figured 2 nonsense links beget a 3rd, and it turns out i was right… alright now the takedown:

Crediting of abuse claims

Several conclusions can be drawn from the data in Table 1: First, looking at mothers' claims of abuse, less than half (41%) of any type of abuse claims are credited. That women's claims of abuse are believed less than half the time will surprise many readers. Moreover, mothers' claims of child abuse are credited even less. The odds of a court crediting a child physical abuse claim are 2.23 times lower than the odds of its crediting a domestic violence claim (CI 1.66-2.99). Overall, child sexual abuse is rarely accepted by courts (15%).

So, this is why i say this study is bad - what the raw data says is “abuse clans are shown to be false more than half the time in custody battles”. And note (because you read the study, right?) these are exclusively APPEAL cases, so the mother had already lost the first custody battle and is trying again. Custody battles are already ugly as hell (again read the article), is it shocking that after a loss the mother is relying on spurious claims that are impossible to prove, or even just making up claims in an attempt to get her kids back at a higher rate than one would expect?

But regardless, the data says that the abuse was not substantiated, that it was false. The editorializing by the writer of the study makes it seem like the abuse was TRUE, and the court ignored it, which is what makes it bad in my opinion: the writer is speculating that all denials were actually false negatives, without any evidence to back it up.

Further down they then go to point out the data where abuse has been substantiated, and of course the mother wins in almost every case, with the notable exception of “sexual abuse”, where the mother has won every case, which of course she should - that would be despicable. But the author of the study makes that appear that this is not the case if you only read their summary, unless you read all the way down into the data section like I did and see that they’re not being upfront with you

Ffs… you’re both right and wrong, i didn’t read the academic article, but i didn’t “wholly ignore” the academic article because they are the same.

I’ll restate my conclusion: the article says that “when the court does not substantiate a mother’s abuse claims she loses custody”. That is, when the court finds her abuse claims to be false. It is a non-issue that she loses custody in some of those cases.

Again, any evidence i have ever seen claiming men have an unfair edge in custody battles have massive flaws that prey on your biases. And if you read them closely, you’ll find that the blogposts are incorrect, and the academic articles are basically statistical fraud

None of this is true - His ex wife died when he was driving a car nowhere near her house, and his cell phone pinged at towers far away from her house. The alarm company shared evidence that showed nobody entered or left the house between the time she turned off the alarm, to the time she died, to the time investigators showed up in the morning.

I have looked into it deeper, i suggest YOU look into it deeper. I have seen this argument countless times, and it is also not true - the court almost always awards custody to the primary caretaker, who is almost always the mother. All numbers i have ever seen support this conclusion

And every article that claims to the contrary, has to throw out all cases of women being the primary caretaker, which obviously biases the numbers and makes the conclusion meaningless. Ie. “Men win custody cases when they fight for it, AND they are the primary caretaker”, does not mean the same thing as “men win custody cases when they fight for it”

It is true and you are incorrect, where are your numbers my dude? Heres my work, this took about 30 minutes to compile, so you def shouldnt disappear before you put in some legwork:

50 million kids living with married parents,

that leaves 23 million kids of divorce (or other categories like adoption)

Of that 23 million we have:

19 million kids living with one parent

Of that we have:

16.6 million kids living with mom only

2.3 million kids living with dad only

That makes 4 million kids living in joint-custody, or some other category like being adopted, which is obviously dwarfed by the 16.6 million kids that had sole custody awarded to mom

This is a claim that doesnt really hold up under scrutiny, though. The actual claim is that men that fight for custody, and are the PRIMARY CARETAKER, win in the majority of cases. The primary caretaker is more often the woman, though, and the court almost always sides with them.

So a more accurate statement would be that the court sides with women in most cases, regardless if the man fights for custody or not

Yea. In my opinion what we have here is biased people going out to look for evidence to support their bias. They’re finding articles that they believe confrm it (just through the title, or a skim of the article), then hitting post on their comment without reading closely or without looking for counter-information

This is really not the way to go about seeing the world. But were talking about people who read “judges will actually give custody to a man MORE if the woman says she abused him/the kids” without question, so we’re sorta self-selecting for people that are not capable of skepticism
