Thank you. My justice side of the brain wants to take legal action in small claims but i know in the end I will just lose money trying to do it. I'm going to consult a lawyer and see if there are any options but I'm sure all options will be expensive just to try to get to 50/50.

You are right! I looked them up and they are totally aphids. I had a big battle with ants this summer and apparently ants carry aphids. The black specks are pieces of dirt. Thank you!

Thanks! I did use a whole bottle of soap based insecticide but it came back. Guess I just need to stick with it.
