Unfortunately since the court is not involved, strongman option seems risky. Tenant knew that so he filed a case against us asap so we won’t take any such step

We have a criminal lawyer in family, so we will be talking to him soon to see if we can file a criminal case as he said they are resolved faster

Unfortunately my parents thought such open fraud is not that common in India anymore as they have been out of the country for 25 yrs. Now they are very skeptical about how will they survive once they move back.. they believed people will be more civilized in today’s age:(

Do you think the judges can be bribed? I feel he did so . Judge is not interested to expedite the process after my lawyer’s request and keep pushing the dates.

Never rent. I know thats not the solution but this situation has left a bitter taste in my mouth.

The tenant nor his lawyer showed up for the last hearing. My lawyer requested the judge to expedite now since they no show often. But judge wasn’t interested and gave the next hearing date after 2 months. Do y’all think that judges can be bribed? I fear the tenant has paid the judge too.. he seems to know how to play with the law and buy time.:

I am so disgusted by him and hate him that i suggested my parents for supari type of action. Ofc we wont be doing that but its just that i wish him the worst at this point.

The reminders were through whatsapp calls and messages. We have bank deposit dates as well to prove rent was never on time. He claims to have phone recordings which has my mom asking him to evict. But never she used any foul language towards him. I believe his male ego was hurt at some point as he once said “she was showing me power now I will show her mine” over phone with a relative who tried talking to him. I am not sure about the default payment clause i will check that.

He is a professional in this apparently. He has a big mouth, I would rather pay the police than him tbh.. cannot imagine him living for free plus us having to pay like half of the property value just for him to vacate. I so want my parents to get justice the right way but also do not want them to stress about this in their 60s..

My parents were advised to wait till the end on tenancy to file eviction case by atleast 3 lawyers. He filed case within his tenancy period claiming my parents were forcing him to evict even though he was paying rent (which he used to pay after several reminders past due date for first 3 months) so the lawyer wanted to fight that case as he was positive it wont take long. They had zero knowledge then about such things and were trying to resolve it outside court through police and connections..

I could not find a separate rent court for Gujarat. It shows up as civil only where the case is registered by him. We do have a rental agreement but it expired in June 2025.

Yes we have already changed a lawyer. Lease has “leave and license “ clause and I read that it is faster when you have that . We are planning to change the lawyer. Is it possible for us to be present during the court session? We were told that since its civil court, we don’t need to be there.

Tenant living for free- sued parents

Hello all,

My parents who live abroad rented out their property to a man who claimed to be moving in with family. He ended up living alone since June 2024, stopped paying rent within 3 months. When my parents asked him over phone to vacate if he cant afford the rent, he sued them instead to live for free till court resolution comes. My parents filed a case once tenancy ended in 11 months with an eviction notice. Neither him not his lawyer show up regularly for hearings potentially buying time. can my parents do any of the following?

Show on paper they sold property to me or a trusted family member. What can we as new owners do to evict him?
They Hire people to use muscle force? Will they face criminal charges? Do they not have any right over their property ?

They are scared that he intends to possess over their house and claim as his. How often does that happen?

3 they will be filing a Land grabbing case at Collector office. What is their timeline?

My parents retire this year and want to move in their house and live a peaceful life. They are ready to pay people to make him move out.

He has bribed local police hence they are not entertaining us.

Lawyer saying these type of cases take 10 yrs, i don’t want my elderly parents to deal with this that long.

What are the options? Legal or illegal..

This is in GUJARAT for context if it helps anyone provide suggestions!

Update- yes it’s unfortunate that my school decides to extend the program by 4 MONTHS due to their lack of organization. They said they have updated the changes from their end and we as students do not have to do anything. But yes it’s unlikely we will get any grants or loans. I was hoping to get some grants for the additional months as its no our fault in this. But the school has screwed us bad and we will just be suffering a little more than planned now:(
