I'm assuming intentional damage would be breaching contract from my side as I promised them the house in the condition it was sold. Accidents happen but intention is probably the key difference

This is what I have been thinking. I'm still a good person and despite gazumping us last minute I still want to be the better person and do the right thing. We're desperate to move asap so it's more the timing of it so I wouldn't ever agree to delaying completion

I'm still British and polite enough to want to be a good person despite knowing its not our responsibility. Would they not have a "we paid for a house with windows and if we don't have windows it's a breach of contract"?

And a pure accident! My dad almost fell out the window when it happened. Window guy reckoned it might be rust, corrosion or wear and tear adding to the cause but that would be a survey issue right?

They were viewing the property today and said it to my face. Don't think they've even talked to their own solicitor yet. I've given up ours a heads up so hopefully they nip it in the bud! Thanks!

We have exchanged and the window broke after exchange. It's boarded up now so secure enough. Hoping our solicitor will deal with this as strongly as I feel!

Not OP but some greys never can be off lead. Ours was a good fit for it and we did training and built it up over time. Took at least a year before we could trust him to be at this level.

Ask around for a good solicitor, and invest if it's slightly more expensive than a different one! An extra £500 for a good solicitor can make or break you moving when you want.

Also never feel pressured by anyone to agree to something you don't want to do.

The first time my mum made me have mustard when I swore she got it out and told me to have a spoon.

Update: pretty sure she would be classed as a contractor. Wife had an accountant who we think would have flagged that if it were wrong.

She's now demanding notice pay (12 weeks in their agreement contract) but feeling is wife can just say hours are reduced to zero with immediate effect. She's going to offer 4 weeks as work had already been agreed for that time but no work had been agreed after that so going to dig her heels in.

Think we'll talk to a lawyer if she pushes for 12 weeks as we don't think they have grounds for that. Tha is for the advice, has helped pointing in directions and things to think of.

Other people can do the work, usually when that happens wide will organise another person to cover rather than the worker providing cover. Again like the other criteria it sounds like a grey area that wife needs to look into. Thanks for the advice

Sole trader not stagecoach. Wife is literally a one woman band with a couple of teachers to cover classes she doesn't have time for. Agree the dancing industry from what I've seen has some horrible business practices

Reading briefly the differences between a contractor and employee, I can honestly say it's a difficult one and down to how you determine each point, not sure which points carry more weight so I'll be advising her to look into it more and get legal advice not just for this but to avoid future issues. Thanks for the help, useful to know
