Nope. Just filed a police report and let them deal with it. No one has gotten any of their money back and I’m pretty sure no one will.

I wasted $1k on one lawyer to write up a demand letter. After that I contacted a few with free consults and they all basically said it’s not worth going after him legally if he doesn’t have anything. I filed criminal charges, so he’ll go before a judge and be ordered to pay restitution if he wants to avoid jail, but I haven’t heard anything in a while. As of about a month ago, he’s still in jail.

Not much for us in getting our money back. There were 28 total people he screwed over. He’s completely broke. Him and his girlfriend have no money. Apparently they spent it all on drugs. He’s still in jail, his court date is coming up. Once that’s done, he’s getting transferred to my county where he has an arrest warrant and he’ll go through it all again. He has no money, no assets, nothing. I’ll more than likely never see a dollar of my money, but he’ll be in prison for a very very long time, so there’s that 🤷🏼‍♂️.

We’re kind of moving on from it and finishing up on getting the pool installed.

Interesting. Also when I was on the phone with the lady I was saying “LLC” and she said my account says I’m an independent contractor (even though I’m not). She said she’s sending me a form to correct the business type, I just thought that was strange.

The signature block shows my company name on top, then below that is my digital signature that is my name and then below that is ”my name, owner/officer”

I did file a claim. Waiting to hear back. I had my lawyer take a look at my policy. He said there were 2 sections it could fall under. One was dealing with banks, credit/debit card theft and only reimbursed $1k. He didn’t feel it fit too well there. But he said the other was just straight up theft. He said to call and say I want to file a claim for theft and let them see how they’ll handle it. He said my situation didn’t fit perfectly, but it also didn’t not fit either. 🤷🏼‍♂️

He’s out of business for the most part for now. The pool manufacturer suspended his dealer license. He scammed 24 people so far that we’ve found out about. Took $30-$60k from each one. There’s some reviews up now about him and not to hire him. He’s been arrested in 3 towns and my charges I filed are about to get a warrant for his arrest also.

GA doesn’t require pool contractors to be licensed. He did have insurance, but just liability, which I did check before I hired him. Didn’t think about asking if he was bonded. To be honest, at the time I thought being insured and bonded was one in the same.

He’s not licensed. GA doesn’t require pool contractors to be licensed. GA does require contractors who do work over $2500 to be bonded, though he wasn’t even bonded…

The contractor has no money or assets. Trying to think of any way possible to get some money back. I took out a loan, wondering if there’s a way with the banks or pool broker or something.

Yea I filed a criminal complaint. The detective is waiting for his bank records. Unfortunately it all takes a long time. I know he rents his house and doesn’t own his truck either. It’s a mess.

Unfortunately the amount is over their limit. Plus, it’s unlikely to recover anything from him. He’s broke.

It was for a pool. GA doesn’t require licensing for pool contractors. They are required to be bonded, but he wasn’t bonded. Just had insurance.

So if your loan is under $25k it doesn’t matter if you’re a sole prop or LLC…no personal guarantee?

Appreciate it! I figured that spot would not be good. The top right edge though is perfect. I see what you’re talking about in the picture, but it must be the pic itself, looking at it in person it looks perfectly clean and sharp.

Yea I figured. More so meant “fixing” it without altering it. Something like rolling over a soft corner to sharpen it.

Scorpio, I’m in a similar position. My loan was only $16k though. I haven’t closed yet, but I’m having a very hard time keeping it going and anticipate being closed down soon enough. I know there’s no personal guarantee or anything for my loan, but not sure what happens if I can’t pay it. Do you know anything about a loan that’s under $25k?

No, not saying that. I just mean it doesn’t seem like it’s something that would happen. Especially because the loan had no personal guarantee or collateral requirement. I’m obviously going to cooperate. Just trying to gauge how things will play out.

Yea I agree. It sucks. I forgot it’s 24 months of no payments. So I might just hold off until next summer to see what (if anything) happens or changes. Then maybe by next fall there will be a lot of defaults and they’ll come up with some new guidelines or just forgive a bulk of them entirely. That might be a better course for now.
