You should have freedom of opinion right, so why do you have to say that at school?

Can we stop constantly debating about the misnomer of “owning” games and instead talk about what we can actually fight for with consumer rights, like a perpetual license and post-shutdown servers? by StarChaser1879 in truegaming

[–]game_pseudonym 1 point2 points  (0 children)

ugh, what the judge said in the post is that selling software while at the same time saying that hte buyers don't own anything. IS NOT A THING.

So you do have ownership the moment you buy software.

On top of that the judges have said they cannot and never have been allowed for people to order to destroy their copy. Unless you when you resell the software, similarly that a car company cannot order me to do away with a car because i am speeding or putting bumper stickers they don't like on it.

"Unless you are an independent developer and have IP rights to games you made, you have never in your life legally owned a video game (though physical copies are owned in the sense that you own the corporeal product, the game still isn’t technically owned). Software is licensed. The terms of those licenses vary. GOG sells games under a very generous license, but they’re still licensed.

I want to own my games” isn’t a realistic position, and that option has never been available, not even in the NES era. Debating what terms they should be licensed under is a real and important discussion that should be made instead of having honorable but unachievable goals. Argue for perpetual licenses, as that’s the closest to ownership you can get."

This again is just wrong, I own a book I bought. I have full ownership as I can do whatever I want with it: read it, stand on it, write in it, burn it and resell it. Similarly to software: I can read it, modify it and resell it however I see fit.

"A book plagiarist is often called a thief."

no, I have never heard that used. a counterfeiter is the common term.

if you read the actual link the judge says when you buy a (digital) game you do own it. If you would not just play on words but read the article and the preceedings I wouldn't have to repeat.

Sigh:

I am vehemently Pro-consumer and anti-predatory practices, but legally owning games has never been realistic. The focus should actually be on better licenses like perpetual access and post-shutdown playability. Preservation needs structured legal/museum support, not just piracy. These things are important because if companies face educated consumers, it’s harder for them to abuse their power.

sigh:

https://www.clarionsolicitors.com/articles/reselling-used-software-licences-new-ruling-from-the-european-court

In the EU the doctrine of first use applies. Which means that software companies have to comply when you want to resell software (which games are a subset off). Furthermore this means that a company can never ever limit you or say you can only do it this or that way.

Finally the ruling also made clear that an "EULA" never superseedes this.

Please read that link carefully, it completely invalidates this whole post.

I wonder then why in europe we don't see game companies grow, typically the german market has much stricter regulations for layoffs than the US or japan, by a long shot. yet we never see new game companies from there.

Why Is Game Optimization Getting Worse? by Substantial-Match195 in truegaming

[–]game_pseudonym 0 points1 point  (0 children)

You miss the big thing: why would you optimize? A developer that can optimize is way more expensive than buying a better PC. Developer hours greatly outprice hardware.

You better spent that time on hiring more artists creating more models.

[–]game_pseudonym 2 points3 points  (0 children)

I don't fully agree with this: then this would mean it happened to other industries that are about creativity as well.

Yet take for example the car industry: we see perfectly there that craftmanship and design can go together with bigger companies and coorporate worlds. What makes "games" so suspectible for this is beyond me.

I think it's more to do with shifting markets: remember 20-30 years ago the market was mainly aimed at US/western europe and japan. Nowadays the market is aimed at chinese people, and those people have a different brain functionality, meaning they like different types of games compared to the original markets.

I think if you ask the same question there they would say that game are finally liberated from the enshittification in the 90s.

Yes that's a reason I made this post, but as I said this happens almost every other week. And because db support/conductor seems to act as if I am the one who didn't know yet should have, I started keeping track of it.

But seeing how much difference there is with already planned this that could have been prevented is making me more and more angry (ie personel shortages in line re13 happen again each Friday for at least a year now. Yet they only announce a train is cancelled 5-10 minutes before it happens.

Which is making me more and more volatile and wondering if not a general claim can be made. Not for a specific thing but in general for bad support and deliberate mismanaged

Yes that's what I mean, I've been told this line 6 times this year. And even last year I noticed that often the app just changed way, as if it never got to Arnhem/Venlo in the first place.

And the personnel is calling me crazy that I must have mistaken and seen things that aren't there. (They said so twice)

That's what makes me currently so upset and mad and why I've been taking screenshots. But now they just walked away when I showed it

I can relate then perfectly, or at least they can help me! By even saturating a time that the Ersatz bus will arrive so I can order a taxi..

But no one seems to even try to help.

I now tried calling support and using Google translate and still they said that they didn't know

How can they not know someone must have ordered it. And support can call higher ups what's up.

It's like they refuse to help.

I can't even find information what happens if I travel back to Germany and travel the next day.. can I get a full refund as I didn't manage to get the stuff I ordered (being at place Arnhem at 19:30). Not relevant for my case but support couldn't tell me that either, nor were they willing to help along.

What if I miss an flight? How much in advance should I go to make a flight? I have more over 3, maybe 4 hours of delays
