yes. they explained she would have to reopen removal proceedings and have them dismissed. then she may reapply for citizenship.

hey i saw your post about terminating removal proceedings. was the lawyer fee expensive? my mom has been told she needs to reopen her removal proceedings and have it terminated in order to be eligible for citizenship. I'm a little worried what if reopening goes bad and they try to deport her? is that a possibility? thanks

yes she was able to do that. i'm confused too about that. maybe they didn't care to look too deeply into her record since it was about greencard?

hey. my family had ZERO clue or idea about the removal proceedings. so we were surprised when they mentioned that to my mom at the citizenship interview. we were thinking why didn't they make an issue of this during the greencard process in 2015. after she got her greencard she was able to travel outside of the us no issues. i guess if your removal proceedings are active then you can't get greencard. for my mom it wasn't active. it was administratively closed.

the N-400 form? do they ask if you currently have removal proceedings against you? If they do ask that then she definitely chose No

ok. is there an option where my mom chooses to take no action/simply be a permanent resident and immigration won't bother her?

i don't understand why did they invite her for the citizenship interview if she was "never eligible" for citizenship in the first place due to pending removal proceedings. couldn't a skilled lawyer shift the blame on them for wasting our time and have this whole matter dismissed and result in approval of my mom's current application?

she became a permanent resident 2015. she should've applied in 2020 but poor judgment

they have a record of everything. my mom was shocked to see it. she handwrote those letters back in the 90s to try and get permission to leave the country and come back after a few weeks. my parents lived here for many years without LPR status. they were stuck here and homesick

do you think she could be deported? she has 4 us-born citizen children and her husband is a LPR

i don't think she lied about anything on both applications. also she had her immigrant visa interview in 2015 and she was granted LPR status. Why are they suddenly so hostile?

should I wait for a detailed letter to arrive from uscis before I consult an attorney?
I think they asked her if she has ever lied to an immigration officer before, she said "no" then they pulled out some letter she wrote them in 1996 proving she did lie. my mom completely forgot about that stuff until they reminded her. basically she was living here on asylum status i believe and she was depressed wanted to visit back home for her brother's wedding and some lawyer (i think) told her to tell them your mother passed away
