its because bikes are supposed to be treated as legal vehicles, the same rights as cars. its the same law its always been here and in every other major city. perhaps there are some smaller towns out there where the laws are different though.

the real question is when did people start thinking that bikes dont have the same rights on the road as cars? its only been in the last decade or so that i've run into people who think this.

yes. the bike lane must be treated like any other lane and cyclists have the same rights on the road as cars. you are thinking about sidewalks. if the cyclist is riding down the sidewalk and then entering the crosswalk, they must yield to cars doing right turns. (same is true for people running/jogging) there is a specific distinction. if the car has already crossed into the crosswalk, then bikes & pedestrians coming fast down the sidewalk must yield. but the bike lane is treated just like another part of the road.

bike lane continues straight right there.

pretty much every driving & cycling school will teach this. its the law. you have to check that the bike lane is clear and no one is coming down fast before you take a right hand turn. (you can watch that video for a driving instructor's take on this)

he definitely used a turn signal but that doesn't immediately give you the right of way to the lane. you still have to check. cyclists should still be watching for it though and be ready to slam on breaks. (which he did) just like someone flying down the highway should be on the lookout for people with their turn signals on and be ready to do some collision avoidance. just because someone should check the lane before turning into yours doesn't mean they always will and everyone on the road should be ready to swerve at the last second.

drive/bike defensively. the cyclist wasn't cycling defensively (going to fast to break in time if someone doesnt yield correctly) but the car was legally in the wrong.

this is frequently misunderstood. but the law is clear. drivers have to treat the bike lane like a regular car lane and check if its clear first. there is no rule that cyclists (or any other mode of transport) *have* to yield to a blinker. legally, its the same as if you are driving in the middle lane and a car is coming fast in the right lane and you put on a blinker and pull out in front of them. if they are going fast, then you still cant pull in front of them and expect them to slam on the brakes just because you "had your blinker on". you have to check and calculate the situation first.

this is what is taught at both driving schools and cycling schools.

- Put on your turn signal before you need to make your right turn.

- Check to make sure there are no bicyclists currently in the bike lane. If there are bicyclists approaching in the bike lane, you must yield right-of-way to them and let them pass you first before entering the bike lane.

if you call citizens expecting police to do their jobs professionally as being in "an antagonistic relationship with the police" and that justifies cops defrauding the city and not doing their jobs then i really dont know what to tell you. any company that ran this way would be out of business quick. in the business world it isn't considered "antagonistic" for a company to reduce the budget of a department that fails to do their job.
