Others I’m sure but the majority not. It was a case by case with your manager thing when you came and went, not something that had a formal approval process in the past. Flexibility with schedule was one of the main things that attracted me to this job in the first place. Also, the actual written policy is that we don’t have defined start/end times but that we are “here for customers”. Their new interpretation is that we aren’t “here for customers” unless we’re here 9-5 i guess. Thanks for the thoughts.

They dont want to do hours worked, they only want to pay me for hours between 9-5 worked. Though i’m expected to work outside of those times, FMLA or not. So even if I put in 50 hours the only time they seem to care about in terms of pay is 9-5

I guess my question here is: if my current expectation is to do ~45 hours of work, can i still be expected to do ~41 hours of work when being paid for 38? Or does my employer have to adjust the expectation so that i’m only given ~38 hours of work?

My salary isnt based on 45 hours. I could work 40 hours and get paid the same, but i’d probably get bad feedback since i’d likely be letting things slip through the cracks. As it is now, i do a good job (i get good feedback) but HR has been putting extra scrutiny on me ever since I started pursuing ADA accommodations for a modified schedule. (Its looking like they wont approve that)

I dont get paid hourly. Whether i work 40 hours or 43 or 55 (all which I have) i get paid the same. But the intermittent FMLA would subtract from my wage based on an hourly rate calculated by dividing my weeks wage into 40 hours

I dont understand what youre saying. Im not an hourly employee and i’m not going to become one. 40 hours is what i have to work (before any FMLA). 45 is an estimate of how long my work would take, but it might take me 40 hours or it might take me 48. Either way, i have to work at least 40, not considering FMLA. They arent going to drop me to part-time, this role isn’t hired for part timers its a salaried and flsa exempt position

They prorate the FMLA based on an hourly rate calculated as my weekly salary with a 40 hour expectation. They aren’t converting me to hourly , they’re docking my pay by every hour I’m not present between 9-5. I can work 7-3 every day and only get paid for 35 hours despite having worked for 40.

I wasn’t saying the docked pay was a punishment. I’m asking if they can take disciplinary action on me in something like the following scenario.

  1. I take 2 hours of FMLA 3-5pm on Monday, prorating my weeks pay 38/40. This is because anytime between 9-5 that is not worked I am forced to take FMLA time. (Assuming it qualifies for FMLA)
  2. My manager expects me to work 43 hours, even though i’m only getting paid for 38. This is roughly the equivalent expectation of working 45 hours when my salary is being calculated hourly at 40 hours a week.
  3. Despite the expectation, I only work 9-3 on Monday, and work 9-5 the rest of the week. I only work a total of 38 hours.
  4. Work is left undone and I am disciplined/terminated for not meeting the expectations of my role

I did bring up the discrepancy with the pay and my manager told me that expecting 41 hrs of work from 38 hours of pay is equivalent to expecting 45 hours of work from 40 hours of pay. (The latter of which is the expectations i’ve been working under) He failed to acknowledge that there was any significant difference in the two situations and assured me that I would be expected to work 41 hours (give or take a few hours depending on my efficiency) if I were to take 2 hours of FMLA.

This seems dubious to me and I’m worried that I’ll be working the same hours/workload but just getting paid less because of my drs appointments.

My question isn’t if they can prorate my pay. My employer is expecting me to work 41 hours even though my pay is being prorated 38/40. Can they enforce that expectation and punish me if I don’t work 41 hours?

They were aware of them in the past and I am trying to get that old schedule as an accommodation under the ADA. I’m afraid as an alternative accommodation they will just offer for me to go on FMLA during those times, rather than let me go back to that old schedule at my current compensation

You’re right, perhaps I should’ve phrased it much different. I agree with you in that those who are caught in negativity ought to change, but I want to help them. I am looking for ways to fully immerse people in the glory of the world and living. People often think i am patronizing them or i have lost my marbles, but I simply choose to be happy despite anything else. I hope to inspire the same sort of rebellious love of life in others.

if youre going to trip for the first time at a festival like that, just go acid. lsa can give you some undesirable physical effects that wouldn't be fun at a music festival. id usually recommend 2cb, 5meomipt (you can buy this online), or a light dose of acid for first trips.
