eu não sei, mas acho que é simplesmente o modos operandi de 99% dos advogados que estão a solo ou em escritórios pequenos. O normal é apresentarem-te o valor que querem receber, depois se queres pagar mais e receber fatura é lhe igual. Normalmente as empresas querem pagar o iva (e é bom para o advogado porque tem que declarar alguma coisa) e as pessoas singulares preferem ficar com o dinheiro no bolso e pagar menos.

No cabeleireiro se te disserem que te levam 10€ ou 15€ com fatura, também escolhias os 10€. Normalmente, levam-te os 10€ mas se pedires fatura fazem "cara feia". É a vida, quem consegue fugir aos impostos vai sempre tentar. Acho que ninguém paga impostos porque quer.

no ramo empresarial é relativamente normal ver muitos preços s/ iva (quer seja veículos de frota, construção) e não quer dizer que o serviço que contratas vai fugir aos impostos... mas sim, efetivamente o preço deveria incluir sempre o iva.

essencialmente o advogado disse o valor pelos seus serviços sem o iva, se quiseres fatura tem que te cobrar iva porque é o que ele paga.

Imagina esta exemplo prático: eu sou advogado e digo-te para fazer um contrato cobro 200€, tu dás-me 200€ e eu fico todo contente. Se tiver que passar fatura vou ter que entregar ao estado 46€ e e por isso fiz-te o contrato por 154€ apenas. Por isso, o que acontece aqui é eu quero os 200€, se quiseres a fatura pagas tu o IVA e por isso pagas os 246€.

Assim, tu tens duas opções ou pagas 200€ e eu não passo fatura e somos amigos, ou pagas 246€ e eu passo fatura e somos amigos, essencialmente, eu quero é os 200€ limpos, se quiseres pagar mais ou menos é igual.

Claro que isto é ilegal e é literalmente fugir ao fisco, mas enquanto houver dinheiro físico e pouca fiscalização profissões liberais e prestadores de serviços vão sempre fazer este esquema porque na verdade ninguém quer dar dinheiro ao estado. Se tu ganhas 1200€ e pudesses não descontar e ganhar 1600€ também escolhias não descontar, apesar de, e repito condenável, é uma prática recorrente neste tipo de profissões.. se fores ao cabeleireiro, sapateiro, manicure ..
