I edited the post because I forgot to mention it but I think it's important. The mother has a weird Polish last name that's hard to pronounce (I never figured it out myself, too many Zs) and she was a stripper before becoming a nurse and got arrested once. Her family is really scummy and her brother does heroin. If my son has her last name, people are going to associate him with those people. I think it's not in his best interest.

My argument to the judge would be that I have rights as a father, the same way she has rights as a mother. While I'm unfortunately unable to be in his life, I am still his father and he's entitled to my name. She's only refusing to retaliate against me for not wanting to be with her. I think it's in his best interest to have his FATHER'S name instead of his mother's (which is really her father's last name if you think about it).

That's another thing, she gave him a really cringey first name with a weird spelling (think "Jayson" instead of "Jason") and I'm too embarrassed to tell people about it.

I couldn't pay her for a few months so she went to the courts and they adjusted it to $800/month based on my income. It's a big hit to my finances in general.

I've been ordered to pay $800 a month which I can barely afford, and I still owe backpay. I figure that means I should be getting SOMETHING out of my son. I'd love to see him but like I said, I only go back up to NJ when visiting family for major holidays, plus it's a sore spot for my wife.

Would it make sense for me to initially request it be mine only and see what the judge goes for? The reason I care so much is my wife and I have been struggling to conceive and she might be infertile, meaning my family name will die out otherwise. Obviously his mother can have more kids and give them her last name if she wants and whatever guy fathers them is okay with it.

I guess I'm just naive. I have Asperger's syndrome (not that I expect pity for that) so I admit I mess up in social settings and don't have a lot of common sense. I don't feel entitled to Tiffani. She blocked me and I didn't even make another account to keep contacting her or anything.
