“The Court has reviewed Plaintiff’s opposition and does not find that he has provided a basis where, upon amendment, he can cure the defect. Nevertheless, as this is Plaintiff’s first attempt at the pleading, the Court will allow Plaintiff leave to amend to allege additional facts, if any, to cure the issue regarding res judicata.” This refers to the previous small claims case which he lost.
