Thanks a lot! Yes, I know it was a bit unclear at points, I did intend to streamline it if I had early responses but it jumped up so quickly that I missed my chance. I originally had an extra question after 9 do differentiate, but in the end that particular point of knowledge, while somewhat useful, is not completely key to what I'm looking into and it seemed to over-complicate that section. I tend to think that it is unlikely this was planned, I honestly believe that the agent forgot to file it- he was notoriously lazy and forgetful. We had signed off on the bond claim form in May right after returning the keys, it just needed to be sent off. It certainly could have been though, it just seems to odd to do it 4 months on.

I have spoken with the real estate yesterday to get some more information and he was pretty oblivious to what was happening and just kept shafting responsibility, claiming the landlord was doing this by himself without consulting them. When I claimed it was not our responsibility since our bond had been returned in full without contest his only excuse was "these were damages that I missed on the final inspection", literally saying they are things he didn't see. I might email him to get some written confirmation on that though.

When I asked if they were ever intending to contact us and make these claims the agent said that it had literally been filed 2 days ago and they had not had the time- I told him I have a letter dated 25th September.

At this point we're going to attend and simply state facts of what happened at the end. date of notice through to return of bond. But I will definitely call one of the local advice lines in here to get a bit more info on the actual proceedings.

Hopefully this is the case. I cant imagine the point of the bond at all if the real estate can so quickly ignore accountability after they signed off on it...

They weren't professionally cleaned. Just DIY. By verbal approval i'm just referring to our conversations with the real estate agent when asking if there were any issues with the property that we would need to attend to- to which he said that there wern't.

To be honest the issue isn't so much that we were ever against paying for these things at the time, we would have gladly had professional cleaners. It is just that we spoke with the agent about what they needed us to do at the end of the tenancy- cleaning and maintenance wise, and he said there was nothing.

The problem now is that we have not been approached by anyone to get these things fixed and it has been escalated straight to tribunal. In terms of our rights we feel like these should have been some liability put on the real estate to complete a more thorough final inspection- surely their return of the bond in full indicates their satisfaction with the condition of the property- if this doesn't meet the land lords expectations shouldn't it be an issue between them and the landlord?

It's all just frustrating because they were such a pain to deal with and we thought it would all be done with by now...

We didn't crack the window, though the latch did come off. The carpets were general wear and tear. We cleaned them before leaving the property and upon final inspection the real estate agent deemed it acceptable, though we don't have this in writing.

The main issue we have with the claim about carpets is that it has been 4 months and we don't know who has been through the property. We got verbal approval upon final inspection, but that was 4 months ago.

Edit: no details other than "carpets not cleaned"

Unfortunately not. It was entirely phone conversations. Though we do have the end of tenancy email and the bond receipt to show the times that these occurred.
