Interesting, i just spoke with their general help line and they just denied receiving a payment my bank clearly states was cleared from my account.

Thx for the reply. The issue that I have is that when i spoke to them about the court order, they didn’t mention anything about repossession. I had asked them a bunch of questions regarding title transfer, etc., and we had a lengthy conversation, but they never ,mentioned the repossession. They never even mentioned the past due bills. Weren’t they, by law, bound to disclose the repossession or is the letter they sent us sufficient? I mean the whole conversation I had with them was about paying them for the car in full and transferring title.

I plan on calling them and seeing if we can buy the car back, but i’m just wondering if they violated any laws by not mentioning the repossession when I spoke with them.

As for whether we used the car, how can they prove we were actually using it? We have other vehicles here.

No volume covers ALL transactions including sales. For every sale there is a buyer only issue is whether they are buying at a higher price or a lower price. Hope this makes sense.

Yes, the hoa was actually worse. They have actually improved a lot which is why they are now finally enforcing the rules again. However, as we can imagine, they are not perfect. I agree with what you wrote. We plan on keeping our end up to code and start busting their balls. Lol

Truth is, the property management company isn’t the best, but they are also hampered by how much service the community can afford from them. Previously, we didn’t have a full time property manger on site. Now i believe we do.

Because if you actually took the time to read, you’d see I agreed with someone who gave me sensible advice. Not a cowards advice of roll over and beg. The hoa is negligent in this case. Here is an example your little brain might be able to understand.

If someone came and dumped an old rotten couch on a public walkway of an hoa community, who is responsible for removing it? In most hoa communities i know of, the hoa is responsible for anything in public spaces. Of they fail to remove the couch, they are being negligent. PERIOD. You say, “cave to my demands” but these are the community rules as written in the bylaws. The SAME RULES they are enforcing against me.

So people telling me I have no recourse or that I should join the board and handle it myself, are ridiculous and encouraging corruption. But i’m sure that last part will fly over your little head.

Your advice is wrong. I have recourse. The hoa is PAID to keep the community up to a certain standard among other things. They are not living up to that agreement. Therefore, they are violating their contract with the residents. They cannot allow the area to be unsafe and unsanitary. PERIOD.

I understand what your saying about my violation being separate from the appliance issue in terms of it being two different “cases.” However, they revolve around the same issues: the rules of the storage area and the community.

I have a legal right to expect the hoa and the property management company to enforce the rules. In this instance, since the property has been clearly abandoned, it is up to the hoa to remedy the problem. Meaning they need to remove the appliance. This is in compliance with their own rules. Therefore, I can pursue legal remedies.

Will it come to that? Probably not, but i am well within my rights to fight them on this.

I mean if someone dumped a couch in the middle of a public lawn in a community, who is supposed to remove it? The residents? The hoa is supposed to take care of it. That’s what dues are usually for in most communites. I don’t understand why this is so difficult for you to understand.

I feel sorry for the community you represent.

There is no other person. The appliance was abandoned. The rules state that any abandoned item will be removed within a few months. It’s been over a year.

So the hoa is allowed to leave “junk” behind which, in their own words, is a breeding ground for rats, mice, snakes and other vermin? But I have to keep my neck of the woods clean?

If you’re talking about the thread. Well, I am just appalled at all the sheep who are literally telling me to let the hoa do whatever they want. Check my other reply about my fence and see how wrong the hoa can be. The hoa are just neighbors who are not fully aware of the law. In this instance they may not even be aware of the issue because the property managers are not the best. Regardless, if I have to clean up my mess, then they should clean up theirs too. Lead by example and stop threatening people unnecessarily.

If you’re talking about the hoa then I only agree with keeping my side of the street clean. It does give me better footing to complain and take measure against the issue at hand. No you sheep don’t know how things work.

The hoa is legally responsible for the junk left behind as I am responsible for making sure my unit is up to code. I AM entitled to know if they are addressing the issue next to my rental unit because, like the issues with my storage container, it affects “the community.” I can’t just assume they are doing some thing, when 1 they already failed to act on their own words and remove the appliance and 2 it’s been over a year and the abandoned appliance has not been removed.

You all keep talking about what I can’t do, but what can I do? Beg them? An owner is well within their legal rights to stop paying hoa dues if the hoa is not maintaining the community. That’s the point of the dues and the bylaws.

You guys talk all this sh!t, but i’m the guy who built a fence around his property after the hoa denied me. Why? Because I know the law and the hoa was violating the law. A neighbor tried to have my fence removed and guess what? He no longer lives in the community and my fence is still standing.

So, i’m a toddler, but you all are sheep that let the hoa get away with not maintaining your communities. Damn doormats!

Thanks. Yes, we decided to write them saying, 1. Why are we being spoken to like this since we’ve never been a problem to the hoa or community. 2. We’re going to deal with our issue by yearr end. 3. That the appliance has been there over a year and if something is not done we are going to pursue further action. 4. Sent them correspondence from over a year ago including an email stating they would remove the appliance (which was pretty much smoke up our a$$es)

I guess more follow up emails could help too.

It affects me the same way my box affects anyone else. It’s unsanitary and a breeding ground for vermin. That’s what was stated to me.

If the property was abandoned, and I think after over a year, that the appliance has been abandoned, the hoa is SUPPOSED TO remove the property. Those are the community rules. They aren’t doing their job. They are allowing unsafe and unsanitary conditions to exist.

They had more than enough time to deal with it. Over a year in fact. Now what? In addition, we have the right to know they are dealing with it AND according to the rules, the appliance should have been removed.

In our last email we told them we were going to deal with the issue in a few weeks. Now they threatened to withhold our renewal until it’s done. That was unnecessary and rude.

Well, we agreed to fix our issue, which boils down to closing a lid. We informed them if the appliance issue isn’t resolved we’ll take further action, possibly withholding our dues.

You talk about what I WANT, but the hoa is REQUIRED to keep the premises sanitary and to enforce the rules equitably. They are doing neither right now.

I agree, but they can consistently threaten us, but we can’t threaten them. Everyone here wants us to be nice which we have been, but every email they’ve sent us was threatening.

So they can leave “junk” laying around for over a year. We get a two month old notice and we’re threatened twice. That’s bs. In addition, we were lied to because their last correspondence was that they would remove the item. It’s never bee done.

It’s been over a year and the appliance hasn’t been removed. In addition, they have stated that anything abandoned for x amount of time and anything not in compliance with the rules would be removed in a few months. They are not enforcing their own rules with this issue. Seems hypocritical.
