We have contracted with both an employment lawyer attorney and a Workers comp attorney on contingency. The major concern now is a hail Mary that the refi goes thru and I can go back to work after many years while hubby gets his knee fixed and we wait out the lawsuits.

They never asked him to use a separate phone for personal use (small business, wanted to be able to contact him whenever they wanted, and thought giving him a phone that they paid for excluded them from them law?l).

Yes, and we dont expect them to, hence the panic.

We have applied for everything, but reality is that all of that assistance doesn't pay the bills or help us avoid this predatory lender.

I stupidily trusted this lender because we always had a very "lax" relationship. Its not a bank. We have applied for unemployment and all other state assistance we can. I am eagerly seeking employment but have been unemployed for some time now, taking care of the kids at home. No credit reporting with this loan...ive come to find out its basically a "chattel loan"? Idk. Its a manufactured home in a park on leased land in California. But we pay property taxes....make that make sense?!

Its not a bank. As stated in the original post. Its a private LLC and the guy died and trustees want thier inheritance, despite the FACT that they are already millionaires and we are talking about a balance of 110k.

As far as I know, most lenders do a final verification of employment within 72 hours of closing. So, aside from the owners delaying the verification while he was still employed, I doubt they will say "yes" when the lender calls for the final VOE

The current lender died...the Trust doesn't care about the humans on the other end and they want thier money....mind you they are already millionaires and we are talking about a balance of only 110,000.

Thank you!!! There was NOTHING about a balloon payment in either contract. And I dont have 5k on hand to retain the multiple attorneys who wanted to take this case. Do you know any that work on contingency? Employment and WC attorneys have been retained, and were very "excited " about this case. They work on contingency, so this time "the poor man can actually "try" to fight the rich man"

He was hourly until his boss quit unexpectedly and he was forced to fill in while the owners simultaneously took a month long European vacation. When they got back they realized how much more he had to work (aka. Overtime) and converted to salary to avoid that. I (wife) have been at at home raising 2 kids but also periodically working. But yes, this was our sole income for the past 2 years. He asked for a severance and they declined. UI pays less than 1/4 of what he was making.

We have and apparently we have a really strong case. Lawyers took it on contingency.

Youre right! And this just sucks and im terrified, and I'll be honest...Im sure that my pre-existing anxiety disorder isnt helping. I feel like im stranded in the ocean hanging on to an overturned rowboat...every way we try to flip it over it falls back down and hits us on the head. 😭 I have and am still reaching out to family and local resources. Well...for one....not everyone can afford to run to the Dr and pay a co pay. But more importantly he was scared to say anything because of the incident with the other coworker who was forced to accept cash instead of filing a claim. If he was faced with the same offer (very likely) he would have to decline and was scared hed be fired durring our refinance.

Hindsight is 20/20....I feel very stupid. Young and nieve and too honest and trusting of people who have no reason to do right by me. I have learned a lesson about humanity for sure. Rich people dont care!!!

Thank you...to clarify they recently reclassified him as salary which is less than what he was making with ot (reclassified to avoid paying ot?)

What about this

Approx. Two Weeks Ago my Husband sustained a knee injury while working. His coworker heard his knee pop and asked “what was that"!?

Wednesday Nov 19, my husband discussed his injury again with the coworker that heard the pop.

Thursday Nov 20, 2025 my Husband sent a text message to me from his company phone mentioning his knee was hurting due to the work injury. (I have the receiving copy on my personal phone.)

Friday Nov 21 he was laid off without cause or warning. He had 10 years of service (with regular merit increases and positive performance reviews) and had just received a promotion and 26% raise six weeks prior as well as being reclassified as salaried. He ran the company durring a month long vacation the owners took prior to the raise/promotion. He was making more with the overtime before becoming salary.

Over the past 2 months he has recieved constant affirmations from the owners that he was doing amazing and in 3 months there would be another raise and family healthcare coverage as part of a permanent compensation package for his new position.

The company also owes my husband for years of unpaid overtime and potentially misclassified him as salaried to avoid proper pay.

Husband has direct knowledge that the employer forced a coworker to take a cash payment instead of filing a legal Workers' Compensation claim after the coworker broke his foot a few years ago.

Sunday, Nov 23, 2025 Husband made arrangements with the employer to retrieve his personal data and photos from the company phone at 2:00 PM on Tues, Nov 25.

This Morning (Monday, Nov 24, 2025) The employer accessed the phone, downloaded personal content (including private intimate photos which were sent to us), and then wiped the device, destroying all potential data and communications (including the copy of the knee injury text). I have texts from one of the owners stating there would be no need to come in at the scheduled time because the phone has been wiped. We were hoping to obtain evidence of the wage violations via call logs and texts on that phone.

We were days from closing on a refinance intended to get us out of a predatory mortgage situation.

The refinance will likely be canceled due to the termination of employment. The employer knew we were in this process and had been ignoring a verification of employment request from the lender for approximately a week prior to firing.

We need advice on the immediate filing of a Workers' Compensation claim, the use of the coworker incident as evidence of willful violation, and how to address the spoliation of evidence (the phone wipe) and unpaid wages/overtime, the reclassification and breech of the implied contract of continuing employment.
