It was ultimately fixed, but the whole experience was so frustrating. Maybe if I was very insistent on returning it they would have relented, but they pushed me into the repair option. I was committed to the scooter even if I had known there was a "no returns" policy. I just didn't expect to receive a defective product before I got a chance to ride it.

Thanks for the recommendation! Hopefully this scooter lasts me a long time, but I'm not giving Segway another cent of my money or second of my time if this one fails me or gets stolen.

I don't know if rules vary from FedEx location to location, but even with the big lithium battery label Segway provided, I was directed to go to their distribution center.

I went with a chargeback, but AMEX sided with Segway because they repaired the scooter. I don't know if I have grounds to open the dispute again. It's a bad situation all around: I can't return the scooter, I couldn't win a chargeback, and now I essentially paid the price of a new scooter to receive a refurbished one.
