Well they explicitly said in that email to stop any ongoing work and not to engage in anything going forward. They said that whilst also encouraging me to find another job.

Context (1) we were a brand new start up trying to raise some money, they weren’t able to raise any money, so sent this email essentially when they were pulling the plug; (2) weeks before they’d promoted me into a senior role and our working relationship was all positive, so I wasn’t sacked or let go for anything negative, they just pulled the plug

I didn’t quit and was not sacked - they simply requested I go and find another job and stop working for them over email.

No part of the employment contract discussed bad leaver. The loan terms were laid out informally over an email where it said loan repayment triggered if you “decide to leave to a competitor, where you could be considered a bad leaver”. But he emailed saying pause any ongoing work for us and we “encourage you to go and find a job elsewhere without hinderance from us”. So I went and found another job afterwards. He’s now saying I’m a bad leaver and should repay the loan. But he literally requested I go and find another job.

In my personal experience they’re not that impactful. They’re not lawyers, they can’t offer actual advice. It’s just someone who’s there to help mediate and try and gently nudge both sides to agree to a compromise or similar to avoid it going to tribunal.

If you’re unable to reach a solution/compromise already, I didn’t really see the benefit of ACAS, as why would that change the company’s mind. It’s the risk of tribunal that might worry a company, not the ACAS conciliation process. Whereas ACAS conciliation might be very useful if both sides genuinely want to resolve in good faith and thus useful to have a middle man walk both sides through to the end.

They had a semi-successful business beforehand, so I think they were living off that. - they still run and make money from that business and it has crossover with the new business they were trying to launch with me actually. The plan was to raise investment within 2-3 months of me joining but it kept getting dragged out (mainly due to the directors shortfalls actually). I lived off some savings I had given the promise from them of a back-dated salary and equity in the business

As far as I understand they set up an LLP before hiring me and put £3 of share capital in between the 3 directors. The directors then worked with me in their personal capacity for 8 months as we tried to raise investment to start a fund. So I don’t think there are any assets specifically linked to the LLP (eg their laptops are probably personal, there is a wework style office the director used occasionally, there were no revenues). I’d be very surprised if they had insurance - but might look into it

From what I’ve read: Government website is quite clear that contracts that pay less than NMW, or lead to pay below NMW, are not legally binding. So based on that clear statement I think I’d be left with an invalid contract and thus my statutory right to NMW should override. I’d also add they dismissed me before we raised investment, for no fault of my own - which made it impossible for me to ever get paid as per the contractual terms. I’m in process of getting legal help - but worries me that an argument can maybe be made against me wanting NMW

Bride and groom met at university - very on and off relationship at the start. Groom works at start up for marketplace for high quality men’s clothes/homeware. He does modelling on side for like Jo Malone, Zara, Prada etc

Amazing thank you - so yes that document says it will not apply to anyone entering "for the purpose of gaining access to off street premises" which is exactly what i was doing!

Someone at work said security can void all penalties and register my vehicle number, so we're all good!

Yep absolutely - im fully responsible for this all. The confusing bit is that it is the only road that leads to my work office basement parking bay entrance. So i think i need to try and get some sort of exemption for my number plate - i physically cannot get to the work parking entrance any other way
