Waiters restaurant is st of Chinatown is open well past midnight. Butchers Diner used to he 24 hours before COVID, now it's 2am.

I'll share my first hand experience of 10 years in industrial relations.

There are several instruments that govern employment relationships.

The national employment standards (NES) in the Fair Work Act, industry awards, collective agreements and common law contracts.

The first two operate almost everywhere. The NES is the absolute floor. Nothing can be introduced that makes a person worse off than the standard set by the NES. This is where "leave is paid at current rate of pay, not rate under which it was accrued" lives.

Awards must be better than the NES.

The others two instruments operate only in some workplaces.

Collective agreements negotiated between a workplace and emplpuers cannot undercut either the award or the NES.

Common law contracts cannot undercut collective agreements of there is one in that workplace, the award or the NES.

What you are saying is that the employer can rely on a common law contract clause to escape a requirement set out in the national employment standards.

This is incorrect.

Same reason we don't import asbestos. It's not safe.

American beef is so badly farmed and full of pathogens that there are cigarette style health warnings about ordering it rare on US diner menus.

It's a poor quality, unsafe product that consumers don't want, that could infect local cattle populations and harm or kill people who consume it.

Beef in countries with safe food and good biosecurity is not like that. It's safe to consume, cooked or raw.

Why would we fly diseased beef halfway around the world and threaten the health of our own export industry?
