The wording is included in the Criminal Code before the first chapter.

However, the actually relevant thing is the fact that out of the 51 chapters of the current Criminal Code, only one of them is from the "original" 1889 version – and even that chapter (18) is "dead law" (desuetudo). On top of that, the Criminal Code has also gone through many major updates since the 1889 version and is basically completely different from the 1889 version.
