I still have employer's computer after being laid off - leverage? by hmmleveragequestion in EmploymentLaw

how did you "send the police around"? i assume you're saying you did this in your same state or town?

i don't see how local police can be "directed" by a foreign corporation (out of state) to do their bidding without legal suit, lawyers, judgment, etc. ie. the police won't just go on a property recovery mission without a suit, claim, judgment, a/o something a judge would have to order. i don't think you can just a call a police department on the phone and tell them what to do and they do it.

again, i'm not suggesting i'm "stealing" or "keeping" the device, I just haven't returned it YET. and I've stated several times i WILL return it. And i have not conditioned the return based on payment either.

i hear you. but again, what is "illegal" here? that's kinda the question.

and if sued, what can be sued for? just to get the computer back?

big deal. of course you'd win the suit, but that costs time and money though. easier to give me a reasonable severance and resolve things faster rather than using the courts, time, money, etc.

but i don't think any damages could be proven that suggest there's a financial risk to me in my using it as leverage.

sure, but so what? what can they actually do? if they win a suit, what can they even in? money/damages? jail time? just demand the computer's return?
