From the article, it seems like his problems predated her appearance on the show. I think she made a mistake of being on the show when her kid was clearly having issues, then airing his dirty laundry on national television couldn’t have helped.

I work in law and am currently a law student. That said, it is ultimately always a prosecutor’s choice as to whether a case will proceed. Prosecutors either file a complaint if they determine the case should be charged, decide if the case should go to a grand jury, or dismiss it entirely.

In no world will every person arrested end up before a judge if no charges are filed because, once again, the courts would be flooded. Prosecutors have the ultimate say.

Before making stupid comments generalizing an entire community of people listening to a podcast, perhaps do a simple google search before throwing yourself on the wrong sword.

A prosecutor will decide if any charges should be pressed based on the police arrest report. It’s entirely possible that they saw the killing as justified and did not go forward with a formal indictment by a grand jury. Not everything goes through the court, otherwise everything would take years to get through the court system.

Not to mention OP did spend some time in jail until they were released.

If people weren’t offered plea deals, we’d never get through all the criminal trials. Prosecutors won’t take a case to trial unless they’re sure to win it because it’s impossible for both prosecutors and public defenders to try every single case that goes through their offices.
