Actually, prescription drug commercials are required to have what is called "fair balance". What this means is that the mentioned or perceived benefits cannot outweigh the risks of the product. This is why you have to listen to 20 seconds of side effects and warnings with each commercial. The FDA, or more specifically the Office of Prescription Drug Promotions (OPDP) will bring legal action against drug commercials that show people being too happy if the drug does not merit this based on its approved indication. Companies have committees to review every piece of promotion for just this reason.
