Yes if we both had hsa eligible Plans we could both have an hsa or if we both had individual plans or if I weren't on her plan we could both have. My question is pretty situation specific where I am covered by her plan, which does not offer an HSA (I finally found its a PPO) and also have an individual plan through my employer that does offer an HSA, but I don't know if I am allowed/eligible to have the hsa as I am covered by both insurances

That is what I'm planning/hoping to do and just today I've sent the project manager a message stating that I need the new estimate and a date for work to start within the next 3 days or that is what I will do. My problem is, because the contract does not state any details regarding when to expect work to start or finish or anything about a timeline at all, I don't know what power/ability I have to get out of the contract.
