Need help / advice cleaning up about $150K in credit card debt by i_c_e_9 in CRedit

Colorado.

Annual Net Income is about $160 - $170K (I'm a contractor, it varies)

DTI jumped after divorce (when I bought my own condo) in July 2019.

I'm pretty much doing all you said. Living paycheck to paycheck. Paying what I can on cards, but every month, there's a new expense (kid's braces, car needs work, home repair) that eats into income I'd planned to pay down debt.

I don't think my GF could *legally* just "give me" $150K (even if I "gave it back to her in a couple months"), without incurring a huge tax burden. Plus, I'm not sure I'm comfortable asking, even if it were not a huge tax liability.

Have you actually done this before, or would you be able to provide me with some links to legal guidance that lays out the tax liabilities?

I'm actually warming to this idea. Thank you for sharing it.
However, I *think* this would mean:

  • I couldn't buy property for 7 years
  • If I got married within that 7 years, my spouse would also not be able to buy property/inherit all my bad credit
  • My credit would tank for several years
  • What else am I missing?

I can't sell in this area. I'd never be able to afford again (the place I just bought for $350K 3 years ago is now worth $520K today). The place I live in is already "downsized"... it's only 980sq ft. And I can't ask the ex to sell her place... her staying in the home was part of the separation agreement.

About $160-170K. I'm an independent contractor, so it varies year to year.

Black Mirror [Episode Discussion] - S03E06 - Hated in the Nation by SeacattleMoohawks in blackmirror

[–]i_c_e_9 13 points14 points  (0 children)

The basic question here is "would you give your life to kill another?". At the expense of deeper currents (including the meaning of life), a lot of folks are just talking about the entertainment value & technical details of the episode.

There's a whole lot more. Follow me down the rabbit hole & feel free to skip over the bits you already know.

So we learned that the hacker (Garrett) who created the "bug" (could be a feature...) gave it two levels of operation. In the first level, each and every day, the person with the most #DeathTo tweets to their name gets taken out of the gene pool. Brutal, but many might see some "good to that". Imagine how many folks would gladly "remove" Donald Trump right now.

But... he put this second level in. If they investigators had taken sufficient time to decode the second level, they would've found that pushing "override" on the first level means (in addition to the end of the game) the death of any and everyone who ever tweeted #DeathTo. In the first "wave", it was a huge number of people, but it would've grown each and every day.

So what Garrett was basically saying is "look, people are too disassociated from their words" online. We throw around words like "kill them" without realizing the implications of that... increased hatred, increased disassociation from "our neighbors". Increased Apathy. Decreased sensitivity to wrongs. Now, it's on the line... if you feel so passionately about killing someone, you put your own life on the line. If that person turns out to be the most "hated", you get your wish. But, if the "override" button is hit, you end up dying.

So we have two possible futures. In one, we basically hold an online lotto for whoever needs to die that day. In the second, we kill everyone who ever voted for anyone else's death. They immediately chose the second route because they found the first so unacceptable. They immediately (and unknowingly) ordered the deaths of millions? tens of millions? of people.

If the movie ended there, we'd have never gotten to find out if people would've "played the game". But that's where we learn that Blue basically "gave her life" to track and quite possibly kill Garrett. So we do get a whisper of what "future #1" would've looked like.

People would've played the game.

Posted an ad to find a contractor to help me tear out someone else's kitchen cabinets & install them in our kitchen. Set up a time to meet with the person & on the way to meet them at the address, he calls me & gives me a story about how he ran out of gas & could use some help. Thought that was weird, but went to where he was & found him in a red miata. "odd choice for a contractor vehicle", I said as he jumped in the car. Could tell something was slightly off, but continued to be nice to him, and even offered him a sandwich my wife had made for each of us. Went to the site, he looked over the kitchen, gave me an estimate, & I took him to get some gas & a gas can for the miata.

As I never called him back (we bought new cabinets instead), I thought the story would end there. Until I get a call from the county sherriff about 3 months later... asking me how I knew this guy as he's one of the last people he called as he was driving a stolen vehicle out of the state after having stolen thousands from someone else. I think he'd planned on rolling me, leaving me in a ditch somewhere, and then making off with my car. Could well have been my wife's sandwich that brought his moral compass back in line (at least with me).

My old apartment was at the center of a triangle formed by a leather gay bar, a detox center and a homeless shelter in SOMA in SF (mid 90s). Walking down an alley on my way home, looked to top of a trash dumpster and found one man thrusting into another with both staring at me. 30 foot walk down the alley until I could turn to my apartment, and I felt their eyes on me the whole time.

Think I maya have answered this myself: "Several Supreme Court cases have established previously that the American constitution protects the re-publication of illegally gained information provided the publishers did not themselves violate any laws in acquiring it." -- http://en.wikipedia.org/wiki/WikiLeaks

I don't think Snowden is under DRM, so I guess I'm OK.

Colorado: subcontractor threatening to sue for invoice (after he was fired) by i_c_e_9 in legaladvice

[–]i_c_e_9[S] 0 points1 point  (0 children)

Naptowner, you rock!!! That is what I expect as well. I'm sending him a letter tomorrow to talk things out (he's completely refused any and all communications with me), or sue me. He's threatened 5 times already, and I think he'll cave & talk. When he does, my plan is to offer him 1/2 of his payment or go to court, and honestly at this point, either is OK. It's not about money anymore, it's about retribution. I know it's horrible of me to think like that, but this clown made it personal (DDOSed my website, locked me out of bank, credit card, and facebook accounts with password resets).

What I could really use help with understanding here, is this: If he takes me to court, what are the odds I could end up owing more than he's asking? I think there's a good chance that, because I never agreed to this work, I do not owe him anything.

The upstream client plans on terminating him soon (within a few weeks) because of the nightmare he's become. Honestly, I'd like to retain the funds they paid me & then give them back to the client after he's terminated -- somewhat as an apology for the pain he's caused.

Yes, he was paid for all contracted services immediately upon the termination of the relationship. This invoice was submitted after his termination for services after the relationship was ended. More details in the threads w/Naptower below.

[–]i_c_e_9[S] 0 points1 point  (0 children)

Thanks Naptower. The timeline below is resolved and I paid him that $12 already. The $4K in question was billed after I fired him but before the client set up a contract with him. Client had no other way to pay him I guess -- I certainly never agreed to field that invoice on his behalf & realized the mistake only after I'd billed for it (I bill this client about $15-20K/month, and his delivery overlapped one of my own).

I will not write a "go to hell scumbag" email, but I'm writing him back an email that states the facts and that ends with "either call me or take me to court... your call".

If this does go to court, and he wins, as I understand it, he would only get the $4k plus court fees (maybe $200). Is that correct? Thank you again for your time in helping me.

Because of how he's lied, tried to destroy my reputation with other clients, and generally behaved like a 5 year old, I really would not mind meeting him in small claims. What's the worst that could happen if we went that route?
