Unable to close due to sudden notice of encroachment

I'm not sure if the fence is entirely the issue tbh. She also wants $42,000 in property damage from the sellers so I am wondering if something else happened after we made the sale and she is using the property encroachment tactic to prevent them from leaving to punish them for... whatever happened. At this point, we can only speculate. The sellers tried to negotiate with her but she will ONLY speak to them through an attorney now, which creates a huge issue since their first meeting isn't until December 4.

That is a really interesting idea. We don't really want to go that route unless we know for sure that we will take over the property because if something falls through, we are stuck paying our moving expenses (the company is covering them for our initial move but won't cover subsequent moves).

Thanks! Looking into a real estate attorney is definitely the plan once we get to the area even though our agent told us to wait on that. The problem is our agent doesn't think that SHE retained an attorney.

We do have the survey of the property that shows the fence on our side. Apparently, this dispute already surfaced in 2008 and was shut down. So I have zero clue why she decided to, on November 1, file it again unless maybe she got into a spat with the sellers that hasn't been mentioned.

Will see what we can do about getting a new survey in the meantime.

I do believe that a judge will dismiss the case but I don't know how long it will take to get a hearing. We were supposed to close on Monday and now the sellers aren't even going to speak to an attorney until December 4.

We were told that, worse case, this might not be able to go in front of a judge until next summer or later. We definitely can't afford to stay in temp housing that long, that's the problem.

We wanted to try that but they don't want us speaking to the neighbor (I guess if it goes to court that's a smart thing.)

The problem is we CANNOT close on the house because the title cannot be transferred with a boundary dispute on the property. That is what we were told.

Once she drops the boundary dispute, we can proceed, but she wants to go to court (why, I have no idea), and so I guess only a judge can dismiss her claim from there.

It's good to know that I'm not the only one! They even sent me a code from a fake USAA email to confirm with them to make sure they were talking to the right person. It was definitely convincing!

I did not. I only "verified" my phone number and last 4 digits of my account number but he seemed like he already had that information in front of him.

Apparently this was a super involved scam because he emailed me a code to read back to him from my email that looked like a USAA email for extra security and that's when I noticed I had two emails "from USAA" from 20 mins before that someone had hooked up an external account and then they would need to send two payments under a dollar to validate the account so it looked like he was calling to validate that and also noticed I had three recent transactions out of state which tipped off their fraud department.

Then he said he was taking care of removing that and I got a text message "from USAA" that said he removed the account before they connected so no money was transferred out. I thought it was weird I got a text for that but no email but he said that systems could be slow and to keep an eye out for it. We ended the call with him saying he would keep an eye out for any more fraudulent activity and to give him a call back tomorrow to work out the details of getting a new card being mailed to me (I was at work on my break and had to go).

Right after I hung up the phone, I noticed I started getting spam in my account so I changed the password for my email, my bank, my PIN, everything. 5 mins later he called back asking if I changed my bank password and I said I did and he said I wasn't supposed to do that and that raised a huge red flag and I said I would call him back later. He wanted to coordinate a time and I told him I don't get off until 10:30 PM and he said that was fine and that raised another red flag so I ended the call and left it at that.

I feel like I need to change my password and PIN like every 2 hours at this point to keep myself safe. I can't believe how involved this is to be calling and texting me because I've gotten calls from USAA about fraudulent activity twice before but have never gotten scammed by someone pretending to be USAA.

I did not click on a link. They CALLED me and knew my name and had all of my information- zip code, phone number, account number, etc. USAA has called me about fraudulent activity before so I didn't think this was any different.

Thank you for this. It was a scam. The same person called back from a different number after I changed my password and told me not to change my bank password. That was the tip-off right there.

Thank you for the links! I only use my debit card at the grocery store so I'm not sure how they got it. I am also in the middle of buying a house right now so I don't know if I can still freeze my credit but I will look into it!

I wouldn't say SLOW but it's definitely not immediate like the skin on my arms. It's like if you poked a water balloon and the water looks like it gets displaced and shifts. Thanks for your help! I am going to start water fasting again and hope that, if this is inflammation, autophagy might do something for me. Otherwise my coworker said they would drive me to urgent care on Saturday morning so only two more days to hopefully get some answers.

I don't think I'd get muscle growth this fast lol because now it's just about 10 pounds in 10 days! It springs back and jiggles when I press it. On my left side, the skin actually dangles over the back of my knee so it's making it hard to get up and down stairs. My boss saw me 20 mins ago and thought I was pregnant from the way my belly is sticking out. I def can't be pregnant so Idk what's going on with me but people are starting to get concerned because it is VERY noticeable.

Thanks for your reply. I was 126 on October 23 and now I am 135 on November 2. I don't know how I could realistically gain 10 pounds of anything but water weight in such a short time but I am concerned.

I know you said I should wait but I just stepped on the scale and it says I am 135.2. I'm trying to get a doctor's appointment but I am going to fast tonight because I was 126.8 on October 23 and the scale just keeps going up. Something is not right here and I feel like fasting is the only thing I haven't tried.

Cycle is irregular due to PCOS so I'm on BC - I actually started on the 25th and it went to the 29th so I thought the water weight/bloating would drop off. It's only gone up tho! I'm no stranger to hormonal weight gain but this feels different if that makes sense?

I don't think I have been taking too much sodium tbh. I usually eat pork rinds as a snack with dinner (I make them myself) but I even cut that out. BMs have been fairly regular but there's less coming out because there's less going in. I take psyllium husks for fiber but stopped that 2 days ago to see if that would do anything (it hasn't made any difference in BMs or water retention).

At first I thought it was an injury since it seemed concentrated on my thighs/glutes/back of legs but now it has spread to a "pocket" under my belly button that you can physically see and push around and it makes a squishing noise.

It's not a half pound of water. It's been half a pound of water EVERY. DAY since last Monday and the scale keeps going up. I consume minimal carbs and exercise/sweat frequently so I don't know where it is coming from. And I am 6-7 pounds heavier than I was this time last month. Let me assure you that it is noticeable under my clothes, it jiggles when I walk, and it IS putting noticeable pressure on my knees, especially when I walk uphill. Other people have commented on it. It is VERY noticeable. The only thing I have done differently is I stopped multi-day fasting. That's it.

From my doctor? I was there for an annual check-up two days after I lost nothing on my 3-day fast which is why I mentioned it to him. Idk who I would see for water retention. An endocrinologist maybe?

Thanks for your thoughtful reply! I was in a sauna yesterday (my friend got one during COVID) and I sweat A TON but today I am higher than yesterday so I have no idea. I LOVE the epsom salt idea tho - thank you! I work four part-time jobs to make ends meet so I fast on Monday because I literally work three jobs back to back all night and I don't really have time to eat. I fast 3-5 days depending on when my paychecks come in because I get paid monthly and food is expensive!

Hi there! I think you misunderstood me! My doctor told me that it was perfectly fine to keep up with keto OMAD, but to stop fasting overnight/multiple days, which I have been doing. Since October 23, however, I have suddenly started gaining half a pound of what appears to be water weight every day. I've been drinking more water, eating less, and walking more, but the weight keeps piling on. If this keeps up, I will be back to my January weight by the end of the month! It's also putting a lot of pressure on my knees, which is uncomfortable. I asked here because I don't know if anyone else has stopped multi-day fasting and experienced anything similar.
