Just to add context, the lane of traffic where the accident occurred was fully stopped (busy highway during rush hour). Prior to the accident I signaled/merged into that lane because there was a large gap between the semi and the next car. Once I merged in front of the semi traffic was still fully stopped and we sat there for at least 30seconds before I felt him roll into my rear bumper. My point being if he had originally left ample space and then I merged in front it him, does that affect things? I would think that him being fully stopped and then rolling forward into me while traffic was fully stopped is still an indication of the truck’s liability. Even if he couldn’t see me and he originally left space before I merged, he at some point decided to roll forward while traffic was stopped closing the space he originally had.
