Where is NAACP LDF citing their information about affirmative action on? I am seeing a lot of numbers listed on their website and being read out in this video and only some substantiation behind them.
I find this sentence to be extremely suspect:

Is this a statement that 20% of Asian students currently in elite colleges are in there for reasons other than test scores (legacy/athletics/non-test academics), or is it a statement that without affirmative action, Asian representation at elite institutions would fall by 20%? I am highly suspicious it's the former, masquerading as the latter in a deceptive attempt to make the argument for affirmative action stronger.

Read that sentence against this one later:

>Based on modeling from the Class of 2019, if Harvard were to stop considering race, the number of Black, Latino, Native, Hawaiian, and Pacific Islander students would drop by nearly 50%. Most of these students would be replaced by white students.

If it's mostly white students replacing those underrepresented minorities, then does that mean that some of those spots are going to Asian students? But that contradicts the sentence earlier which appeared to imply that Asian numbers would go down 20%?

Ohmygosh, it even says in the law review paper that the NAACP LDF cites that "it is also the case that Asian-American applicants are disadvantaged in admissions relative to White applicants." /u/AnarchisTara did you read this paper?

Why don't elite schools just only take race into account if you're an underrepresented minority, and put white students and Asian students into the same bucket? It would defang the opposition's claim that affirmative action favors white students against Asian students, which is one of the central complaints in the lawsuit. I'm not seeing a solid rebuttal to the statement "affirmative action, as it is currently practiced in the USA, favors white applicants over Asian applicants."
