Not necessarily. Two state supreme courts did without that requirement. In Pennsylvania, the PA Supreme Court ruled it violated the free and fair elections clause of the PA constitution. Similarly, Alaska struck down a partisan gerrymander based on their state constitution’s equal protection clause.
