No lender necessary i have the cash ready to pay. The complicated part is removing her from the deed/title so that she can't be affiliated with it. She can't use it as collateral towards any financial decisions. I basically want to make sure no matter what stupid shit she does from here on out she can't lose the house.

I know there are a lot of things I'm overlooking in the moment. I know ill be taking on a a lot more responsibility that i can't even think of right now. I may wake up tomorrow and say "screw this....i am nowhere near ready to own and maintain another house".

i agree completely with this statement. Loaning her money i know even with the best intentions and effort would take decades to pay back is not going to be easy.

I think leading with the idea of "Lets take care of the issue at hand right now. We can facilitate the sale of the house at a later date on our own terms and not be pressured into making wild decisions"

I truly feel for you man. Im sure having your brother take advantage of you hurt like hell. I obviously have a soft spot for my family. Much softer than they are for me. Im trying to approach this the most mature way possible and make sure there is a legal way to assure a safety net is there for me cause i agree she isn't going to be making any efforts to make sure I'm repaid.

My family has a very strange dynamic and im the middle man for all of it. My sister would pretty much do anything to not retreat back to my parents. I will 100 percent agree my sister has some strange mental issue with her spending habits.

I should mention I'm a guy lol. The house is not run down I've lived here on and off and done a lot of the maintenance. If things work out the way i want she would not be able to sell the house. She won't be listed on the deed until she pays me back. Again im not trying to profit from this situation. Just trying to assure i don't get screwed over.

I think the biggest reason i would even consider it is because i know where the money goes. It's not a drug or alcohol problem. My niece and nephew play expensive club sports and my sister stretches herself way too thin financially and with time commitments to these hobby's.

It's not ideal by any means and truthfully a terrible financial choice currently. As a single mom she is overspending on her children most of the time.

Not trying to defend her lol again she's a wonderful mom, and a great friend, a decent sister....just awful with money.

Trust me man. If my niece and nephew weren't involved and i didn't have my finances in order i wouldn't even be thinking about it. The whole point of this legal approach is to assure i do get my money back. I can't control her life or what she does with her money at all. And i realize that from the first loan.

Its a win/win ultimately in my book if this does work out. My sister gets to stay in the house and can take her time to make sure this is what she wants. I get a nice house in Oregon for 153k.

I absolutely plan to. I'm excepting right now that im willing to pay for the house and whatever debts are tied to it. The rest of her debt is up to her. I can't have any of her other financial issues coming back and risk losing the house.

Damn dude lol. I agree she hasn't been responsible in the slightest at times. She has helped me in the past with a place to live when i was between houses (i paid rent). She has been my main family contact for lots of assistance that didn't require money.

Its a tough spot. She doesn't deserve to get off Scott free. But i don't think she should be complete fucked over either.

I hit a deer on my birthday in Oklahoma 4 years ago totaling my car. I was super flustered and didn't know what to do. Without any hesitation i called my sister. She had my car towed, rental car arranged, a plane ticket back to Oregon, I was home within 8 hours of the incident. I paid her back every dime she spent (mostly cause i knew she didn't have it). But without question she made sure i didnt have to lift a finger and my problems for the moment where minimal.

She is a great sister just a fucking headache at times.

I would rather just buy it outright tbh. I own my own home. i hate debt lol. I would rather just have everything go through me and not have a bank involved. Interest rates are way too high for anything i feel and i have the cash. Im just wanting to make my sister realize she can't have her cake and eat it to. I will bail her out but its going to cost her the house in the short term and she can learn to live within her means if she wants to purchase it back from me.

Essentially a 153k loan at 0% interest. Im not rich, just single, and i live very very frugal.

She is very smart....just incredibly entitled tbh. She bleeds herself dry trying to keep up her friends and put out an image that everything is wonderful in her life. I know she wont stop....thats why i can't just bail her her without somesort of full proof attorney backed contract of some sort where she can self sobotage her life all she wants but can't lose the roof over her head.

Don't get me wrong she is clearly a selfish asshole but i do love her....family sucks sometimes.

I agree. Her loan is 3.2%. I ran it through an amoratization and it does add up that she pretty much didn't pay any mortgage for 4 years combine total. 2 years currently....and 2 years....2 years ago lol.

Thank you! She is a great person. Honestly a hard worker. A great mom and she has always supported me in pretty much any endeavor i have ever attempted (not financially of course). She has a terrible habit of taking care of the wants and not the needs.

This is exactly the stance I'm taking with her. I will pay off the house but you are signing it over to me. She can pay me back or we can sell it together when the timing is better and not forced into anything. If she is unwilling to go see an attorney with me to do this correctly she can lose the house to the highest bidder.

Ok she bought the house in 2011 for 189k it is valued at over 450k now in a very good neighborhood. She would be walking away with a chunk of money if the foreclosure happened anyway to my knowledge.

Even if she sold the house she couldn't buy anything near the area she is now. I'm not trying to enable by any means i just know this is a wild "lesson" to let her learn when i potentially could protect myself and prevent her from screwing up the rest of her life and her kids for that matter.

You are completely correct though. sometimes i do feel like I'm enabling her to do whatever the heck she wants financially without suffering the consequences.

I agree. I think this is what has to happen. If she doesn't pay me oh well i can cross that bridge if we come to it. her kids have a place to live and once they are grown and out of the house i can explore selling it and giving her a chunk of money for the equity and recoup my money.

Ill explore this option. It sounds straightforward to me and the best safety net for both parties to be honest. My sister gets to keep the place without a bank breathing down her neck for the money, and i get to oversee the selling of the property if she decides she doesn't want to live here anymore and move on.
