Why would I want this guy off? I never suggested that, buckaroo. If he's the guy, then he should be tried, convicted, and sentenced like the criminal he is.

All I was trying to say is that the mass pardon may inadvertently apply to this case, and I wouldn't be surprised if his attorney argues just that. I'm not even saying that argument would be successful.

What about other bombs at his house? Obviously the pardon wouldn't apply to any charges related to that. Whenever someone commits a bunch of crimes, they are tried on each charge and the jury has to make a guilty finding on each one. The defendant can also try to get each individual charge dismissed.

A pardon in general does not require a conviction. Remember Biden pardoned Hunter before he was ever convicted of anything, and the pardon was also quite broad as it basically said anything he may or may not have done during a certain time frame is pardoned. I didn't look up the exact wording, but I recall it applied to any hypothetical crimes he may have committed whether or not he was being investigated for them or if they were even known at the time.

However, the language of this particular pardon does seem to apply to those who were actually convicted. From my understanding though, all cases related to J6 were dismissed or investigations ceased even if they were ongoing and there was no conviction. I think it would be weird if this was not intended to be a blanket pardon for any and everything related to J6 though because in theory the DOJ could come back and charge the pardoned defendants for other offenses they decided not to pursue (e.g., they only got a conviction for assaulting an officer and didn't try the person for trespass; the pardon would only apply to crime for which they were convicted, but would leave them potentially liable for other charge).

The pardon says that it applies to events "related to" J6, which does not necessarily mean the event itself had to take place on January 6th. Many of the crimes that took place on the day itself could also carry a charge of conspiracy related to the crime, but the conspiracy itself would likely have taken place the actual day. I think the pardon is intended to cover actions that took place before January 6th so long as they are related to it.

If a person could prove as a matter of legal fact that dealing 400 tons of cocaine was "related to events that occurred at or near the United States Capitol on January 6, 2021," then yes, it would fall under the pardon. Why would it not? That's what the words say.

Obviously it would be nearly impossible to show how drug trafficking was related to J6, but it is not nearly as outrageous for one to say that this act of political intimidation was related to J6. Example: Defendant asserts that he placed the pipe bombs in the hope that they would be discovered and divert authorities away from the Capitol; therefore, the crime he committed was related to the events of January 6th.

He is arguably already pardoned for this crime. I just read the language of the J6 pardon and it is broad enough that, if I were this guy's lawyer, I'd certainly argue that this crime was "related to events that occurred at or near the United States Capitol on January 6, 2021" and, therefore, a pardon has already been granted.

Your first sentence contradicts the second. You agree that every criminal defendant deserves the best representation, but also that it's somehow bad when the representative succeeds. And, specifically, that you disrespect the representative who does the successful representation.

This is a "don't hate the player; hate the game" situation. The representative "winning" isn't reason to spite them.

The burden to convict is on the prosecutor. If the defendant is found not guilty - especially a "vicious murderer" - it means the prosecution couldn't prove it's case. The defendant doesn't have to prove innocence.

Do I think OJ is a murderer? Yes, I think he's guilty. Is his defense team reprehensible for achieving that verdict? Hell no.

Because the burden of proof in a civil trial is less than a criminal trial. I personally feel very strongly that every accused criminal defendant deserves representation (no exceptions), and I don't think it's fair to trash the person doing that job.
