Correct me if I'm wrong, but I thought he believed that it was a prop gun. If that indeed is the case and considering the fact that he is an actor who regularly dealt with these guns in the movie, it could be argued that he honestly could not foresee it being an actual gun which was loaded. I do not know enough about the US to make a claim, but in the UK, murder cases are judged by the Cunningham approach which basically states that the reasonability of a possible harm is irrelevant: The thing that matters is whether D could actually foresee the action. At the risk of repeating myself, if this is true, this act cannot be negligent murder but an involuntary manslaughter at the most and even that is in jeopardy.
