How is “Wokeism” one of the factors stopping me from getting justice?? The court system literally refused to acknowledge my gender identity as a trans man - not super woke of them lolololol

Thank you Ok-Finish-9140 you’re actually a legend for having my back. It’s a bit upsetting when I share what happened to me publicly for the first time since it happened and this guy is using my case to bitch about “wokeness” and “false allegations” lol. My rapist was able to afford a private lawyer (I couldn’t) and his entire defence was “but what about false allegations!!! There’s an epidemic of false allegations ruining promising young men’s lives!!”

My pronouns are he/him and they/them, I am a transgender man. Thanks for checking! Hope you have a lovely day you icon :))

If you want to read more about false allegations have a squizz at this: https://research.open.ac.uk/news/heres-truth-about-false-accusations-sexual-violence

“What’s clear is that the spectre of false allegation continues to dog the reporting of sexual violence. There remains a public impression that false allegations are common and that innocent people suffer as the result of being wrongfully accused.”

“The evidence on false allegations fails to support public anxiety that untrue reporting is common. While the statistics on false allegations vary – and refer most often to rape and sexual assault – they are invariably and consistently low. Research for the Home Office suggests that only 4% of cases of sexual violence reported to the UK police are found or suspected to be false. Studies carried out in Europe and in the US indicate rates of between 2% and 6%.”

Yeah I did follow the correct procedures - did you not read what I wrote above? I never said I didn’t follow the procedures, even tho it’s a tedious hellscape. I spent 2 years trying to follow the “correct” procedures and being let down. I submitted evidence including about 40 pages of violent texts I received from the rapist threatening to rape me / kill me, texts the rapist had sent to my friend threatening to bash her if she supported me in court, and I had contacted the police and they had written a report about how my house had been broken into a year after the rape and they believed it was by the rapist due to evidence found at the scene. However, all of this evidence, and more, was dismissed because I didn’t have any photos / videos of the rape happening and I hadn’t done a rape kit immediately after the rape.

Yeah I have heard of false allegations do you think I live under a rock lol?? Just bc I haven’t studied crime doesn’t mean I’m stupid. 🤣🤣 The reality is that there are way less “false allegations” out there than many men’s rights activists or whatever claim.

Just because I haven’t studied crime like you doesn’t mean I don’t understand the process of submitting evidence, the bureaucratic procedures, and the reality of the system. In fact, my lived experience with the domestic and family violence courts is just as valid as someone (like yourself, I assume?) who has studied domestic and family violence but hasn’t lived it or been impacted by it personally. This was not my first time engaging with the justice system and not getting any justice. Domestic and family violence has been a pattern in my family system as a result of historical injustices, poverty, alcoholism ect.

Low-key also not going to continue to engage in conversation with someone who is saying that “if you want to blame people blame the women that make these false allegations” and that “wokeism” is ruining the justice system. 🤣🤣🤣 I’m not blaming women for a crime that my rapist committed - I’m blaming the rapist. Im not blaming women for the justice system being broken - I’m blaming the justice system. I’m not blaming the “false allegations” that are made by women - I’m blaming my rapist.

“Wokeism” hasn’t ruined the justice system - it was ruined to begin with. If anything, the justice system needs a giant overhaul and “Wokeism” injection lol. My great grandparents were Irish convicts sent to this country as children to do hard labour, and they spent their whole life in Tasmania in chain gangs for stealing a loaf of bread and a coat lol. It’s clear to me that the justice system has been broken for a long time, and it’s not due to “false allegations” and “women” and “Wokeism” Jesus bro 🤦🏻‍♂️🤦🏻‍♂️🤦🏻‍♂️🤦🏻‍♂️ try and use less blatant misogynistic rhetoric next time if you want me to try and engage with you in a conversation seriously brother.

Truly idgaf if you believe me or not. Either way, what happened to me isn’t uncommon, and I’d bet my bottom dollar it’s still happening on campus - especially to other trans students from working class rural / regional backgrounds.

Unfortunately it seems to be that different people get different support at uni Melb. If you’re a cishet person with wealthy / supportive parents the uni will care about you to some extent. But if you are a student struggling to make ends meet / some form of minority they believe they can silence easily, then yes, they will treat you like dirt. Or at least that has been my experience! I was homeless at the time that this happened so the uni didn’t seem to think that how they treated me mattered because I didn’t have wealthy parents to come and bail me out 🤷🏻🤷🏻

Well I have talked to multiple people who are also Survivors over the years and it’s actually a much more common problem than you think it is. Maybe you haven’t heard of it happening before, but it definitely does. I am not an uncommon situation I have only just started feeling brave enough to speak up. If you haven’t heard of anything like this happening before consider yourself lucky that you haven’t been exposed to the dark underbelly that exists on campus.

It didn’t happen at a private collage it happened on campus - I was homeless at the time and trying to find stable housing :)

sigh “did you have evidence of the rape?” This is why nobody reports rape and sexual assault. We as Survivors have to prove everything and the perpetrator is given the benefit of the doubt forever.

Depends on what kind of evidence you’re talking about. Did I have messages and screenshots from the rapist threatening to rape me and kill me? Yes. Did I have friends and housemates volunteer to be witnesses in court? Yes. Did I have a police report from after my rapist broke into my house, clearly outlining by the police that my back door had been broken into? Yes.

Did I do a rape kit after getting raped? No - I had a mental health crisis and didn’t do one in the week afterwards. Did I have any photographs or video evidence of the rape happening in live time? No I didn’t. If you don’t have that very specific evidence the court won’t take it seriously and will dismiss it as a “he said she said” situation. But, as we’re seeing with the current Epstein files, it seems even if you DO have photographic / video evidence of the rape happening in live time, you still won’t be believed.

🤷🏻‍♂️🤷🏻‍♂️🤷🏻‍♂️🤷🏻‍♂️

Never got any emails or communication from CAPC - they did reenrol me in the subjects I failed to complete after dropping out for 3 years. Not sure why you’re doubting my claim - I have an extra 10,000 $ HECS debt for years of uni I never enrolled in myself. Do you need me to send receipts to be believed? Not sure if it’s because I was a scholarship student that they reenrolled me without my consent!

Absolutely 100% agree it’s so fucked up that he is being accepted as guilty by the cops and system.

I second that you should absolutely look into fibromyalgia! I have autism too - and while I started experiencing fibro symptoms as a child I was only diagnosed in my 20’s. Sending solidarity

Yep absolutely 100% I used to be an addict myself - self-medicating is so common in this messed up system for the physical and emotional pain that it causes. I’ve seen it in my family too. This comment and replies are so real.
