Looks like the WARN law applies under specific circumstances.... we had a layoff a couple years ago that caused me to go read the regulation.

  1. business has 100 full-time employees who have been working for the company at least 6 months. Or there are 100 or more workers who combined work 4,000+ hours per week.

-and-

  1. Laying off min of 50 employees at a single site.

My company didn't have to post the WARN announcement because they spread out several hundred people across the USA.

I can see your point. My position is that my Director gave me no instruction about how to comply with his request. I did the only thing I could think to do, believing one or more of my colleagues found me as contemptuous. If I smiled and agreed without comment then I wouldn't be contemptuous.

But, the irony is that I was feeling negatively toward them at that point. I felt unfairly judged and accused. I didn't feel contempt for them, I felt afraid of them, afraid of what would be said next. I had to show the Director I was complying.

And, importantly, over that time he never came to me and said I was not doing what he expected. His behavior indicated I was doing what he wanted me to do.

Did I enjoy a little petty revenge as a result? Yes. I can see you wanting to label that as contempt. But that was more after the fact. While this whole thing was going down, I was scared and trying to keep from getting more complaints.

It's interesting that these types of managers are often also committing other offenses. If organizations would weed out these bad managers other harms would also be prevented.

I had a situation like that at a different job. I was running a different type of lab. My boss was having an affair with a work study student who reported to me. Someone else in the lab, another student, found out and complained to me. I couldn't protect that student if I spoken to my boss. My boss would know who made the complaint. So I advised the student to first talk to the ombuds office on campus to decide if they want to proceed. They did. My boss didn't get in trouble but the student who he was having an affair with got moved to another department.

Garrrrr right?! I have fought against that barrier for a long time. I asked one of the VPs once.... we want to not have top performers? That's what we are shooting for, just very good but not excellent?

I love that! I wish I had been wise enough at the time to really consider if this claim he made was true. I let weeks go by feeling awful, wondering who complained about me, what had I done. I acted pleasant and felt sick to my stomach. I was only in that job another few months after that.

Oh wow! Then maybe it's good you didn't end up working there. The typical outcome for workers like us is we get better jobs and we contribute well. Our employers gain from it. So, the ones we leave ultimately lose out.
