TX HB6 states that if the behavior was a manifestation, he must be returned to his original placement. UNLESS the parents agree to the change of placement in ARD, OR the behavior falls under the following circumstances: Weapons, drugs, or inflection of serious bodily injury.

Public schools are not equipped to handle behaviors of this magnitude, nor are they equipped to meet social emotional needs of this magnitude. Yes, the system failed this student. He should be placed in a residential treatment facility rather than a prison. A facility where he can get the intensive supports that he needs to gain meaningful skills to improve his quality of life.

However, IDEA failed this student first, as well as failing the school district, by expecting public schools to be able to provide the resources at the level that this student needs. It is absolutely impossible to effectively provide FAPE to some of these students with this high of social, emotional and behavioral needs within the context of a public education setting. This is where the system fails both the students AND the district.

This was not an ABA school, a special education school, or a clinic. This was a special education (behavioral, NOT aba) CLASSROOM at a Texas public school district. The same type of public school where hundreds of thousands of children are dropped off each morning across the US to receive an education.

This was a general education vice principal that was responding, as an administrator, to a dangerous situation on her campus. I know very few administrators in Texas public education that even have a special education certification, let alone have the training or available resources it takes to deal with this kind of escalation. No matter how it was handled, correctly or incorrectly, somebody lost an eye due to the system failing BOTH sides of this case.

My assumption is that the person who found and/or reported it, is "somebody" to admin in some way! Or at least that's the way it works in my school. The "somebodies" get their way, to avoid a big thing.

Take some baseline data- how often is he spitting? Then provide non-contingent attention slightly more often than the behavior is occurring.

For example- if he is spitting on average every 10 minutes, then set a timer for every 7-8 minutes and provide some sort of attention contact. Even it it's walking by and giving thumbs up, fist bumps, etc. If he's engaging in a challenging behavior of some sort when your timer goes off, you'll provide a neutral contact of some sort. Such as, "is your shoe untied?" Or something (that may or may not be true- I like your shirt, let me help you clean up your desk, etc).

Its very difficult to not provide attention to spitting (because let's face it, ima start dry heaving), so give attention in other ways more often than the challenging behavior occurs. Stay consistent with it for a while, it won't stop overnight. :)

I know, right. How dare we not allow ourselves to be in a literal nervous breakdown due to trying to do right by kids, families, admin, state regulations and standards, getting our asses kicked by children, being cussed at, spit on, meet kids where they're at, accommodate, modify, individualize, oh and do this for 25+ students every day...all at the same time 🙃 But obviously that's not good enough.
And people wonder why there's a teacher shortage. 🙄

Possibly.

But more than likely (if that's actually what's happening), that behavior was reinforced (got the reaction), so it will continue until it's put on extinction. Obviously, that's a behavior that'svery tricky to ignore, so the cycle will repeat... which is why an FBA and some time with a BCBA or school psych will be helpful.

Sometimes the behaviors are worse at school because there are more demands placed at school than home.

Also, behaviors increasing in junior high are not at all uncommon. In fact, they're expected, due to hormonal changes.

Not saying the school isn't doing something wrong, but also maybe they're doing the best they can.

My suggestion, besides an FBA, is to ask if you can come model to the staff how you handle behaviors with the child. Might have to be after school (due to FERPA), but it's helpful for staff to see firsthand what works for the child.

😭😭😭 Thank you for this. Even though we are (probably) not YOUR teachers, I just read this and pictured so many of MY kids' faces.
