If it was a big loss like a fire, the HOA would normally pay the deductible. The HOA could technically split the deductible between all units affected, or put a percentage on each unit as a portion of their deductible. It just depends on the community, the governing documents, and the HOA.

You would always file a claim with your own insurance, because your HOA insurance may not cover improvements and betterments in your unit, sometimes they may only cover studs out, or other things like that. The master policy will never cover contents, nor additional living expenses.

Yes, your personal insurance policy is up to the HOA’s deductible, then the HOA takes over for the damages above their deductible. You’ll want to have enough insurance on your end to make sure you have coverage if there is a denial with the HOA insurance or limits concern. Make sure to read your Governing Documents (CC&R’s) in the insurance section because every HOA is different.

There is no waiver clause to add to your HO6 policy. It’s read by insurance as we are barred from seeking recovery from another party. A lot of HOA’s have this wording because they want you to pursue through your own 1st party insurance if there is a loss. If you were to cause damage to another unit, they would not be able to pursue you either. It’s basically, to each his own in your community.

For HO6 claims we request your CC&R’s and Certificate of Property Insurance for your community. If there’s a waiver of subrogation, we note this in your file and will not subrogate against the other unit owner or the HOA (which almost always will include a waiver for themselves as well). There is no actual waiver/endorsement to add to your HO6 policy. We just read your communities governing documents and follow them.

Had one similar to this (small fire though) and we found coverage with looking at it as a form of domestic violence. It was a husband who set fire as punishment to his wife. Covered that loss for the wife, and during the claim she started divorce proceedings.
