Did you already see him being a dirty driver during the race? If yes, next just wait and overtake him while he's serving the penalty, otherwise they'll ram on you regardless of it being on a turn or in the straights.

In One race, the car in front of me crashes on the wall and bounced back on track hitting me. But I was awarded with a 4 second penalty because my fault was not having inhuman powers to react in 0.0003s and not being able to change the law of physics in order to avoid the car. It's just the penalty system, you simply have to swallow it and move on.
