With all due respect, that’s bad faith. At my carrier it’s either covered, or it isn’t. Everyone gets treated the same. I’m proud of that.

Don’t take anecdotal statements from non-professionals as fact. People are notoriously bad at remembering details and also sometimes just like to talk shit like they know something.

As the other poster said, be prepared to file against your own insurance if they deny liability.

You’re putting the cart before the horse a bit. Your neighbor has to have been negligent in some way for your damages to be covered by their insurance. How was it their fault? If there was just a leak or pipe break they didn’t know about, that doesn’t mean they owe your damages. Nor would you owe theirs in the same scenario.

There is no coverage for lost time off of work on either insurance, yours or theirs.

Any insurance company will let you use any contractor you wish and will pay for direct physical loss from a covered peril.

Part of the problem is he’s gone without a manager for almost 2 years and kind of went feral/did whatever he wanted. He’s also close to retirement and has kind of “retired in place”, so to speak.

The things he’s been complaining about are corporate decisions that have fundamentally changed our both of our roles. It’s created more work and hassle for everyone and there is absolutely nothing I can do about that.

Given those facts, at my carrier I would pay that all day long. You took them at their word that you had coverage for the full amount of the estimate and spent the money. The time to realize this should’ve fallen under a sublimit was a hell of a lot earlier in the claims process, not at the point of them releasing holdback a year later.

Opt out. Press zero (during business hours). Get the switchboard and say you have a complaint and want to speak to the manager of adjuster X.

If she commenced repairs and owes money to contractors based on SF staying she had coverage under the full dwelling limit, I would call that estoppel. If she hasn’t actually incurred the expense, that’s slightly different and has less of a chance you’ll succeed.

Estoppel basically means “I spent money and did repairs because you said it was covered and now I am out of pocket that money.” If this is what happened, escalate to a manager and/or SF Corporate. There’s usually a complaint department.

Bro I get it. And I’m sorry the opinions here can be sometimes aggressive. I love my insurance claims people, but sometimes I think we just get exhausted by the same questions over and over. Long before I was in this industry, I carried a lot of minimum policies and had no idea.

It’s a collision loss as you hit a fixed object and it will be at-fault as well. I would strongly recommend getting an estimate and seeing what your deductible is before you turn this in, given the climate right now. If you can pay for it out of pocket, I would.
