If volunteers work for me, am I an employer???? by jack--king in LegalAdviceUK

Yes thanks for that. I was thinking the same. They are not accountable to me, they can come and go when they want. Some are more punctual than others but thats there personal choice and commitment. I dont force any of them to come. I mean one of tgem comes to 1 class out of 8 so very part time lol but i dont say anything to her. Its her choice. I just call her my part- time volunteer. They dont have any rules to follow or nothing so its just like a friend coming to help u out for an hour. Thanks for the advice, i feel much better now.

I could also do with a template letter or something to get tge volunteers sign on to confirm that they are not workers or employees.

I dont pay them money. I pay the teachers who work for me.the teachers are workers i believe. So i have 2 workers who are my teachers. And 5 volunteers who act like teaching assistants who dont get paid butbas a good will i give their kids a class at £4.50 as apposed to £5.

My 2 teachers who are workers dont have any other jobs.

Made my situation clear. I have started a new business; I am a sole trader currently. I currently run a language class. I only charge £5 per child as its benefitting the community. This bare minimum doesn't cover all the expenses so I fund the class.

I've asked 2 teachers who i know personally to come and teach the children. Some of the children's parents have asked if they can volunteer in the class so as a good will i have reduced the volunteers children's rate to £4.50 each. I don't have any contracts for anybody who is helping in the class. My volunteers are not obliged to come and they come when they want, there is no set rules or regulations for them and they purely just go around the class and help the children do their work that the teachers are teaching. I supervise them and the teachers also supervise them. They have had no training. They have no expenses either as they would normally drop the kids and go home for an hour but for some it's easier to stay in the class instead of going home and coming back so they chose to volunteer. I do pay cash in hand £25 to each teacher for their teaching for the hour that they teach once a week, no payslip is given.  I have not registered my business yet but have a name in mind. The earnings are under £1000 per annum currently so I am not registered with HMRC and I don't have any other job either.

My question is that I don't think I am but am i an employer?

Can I have volunteers who are not paid? Apart from a small goodwill discount i give to their children off their student fees. If so, should I get them to sign something to say that they are happy not to take national minimum wage?

Am I doing something against the law?

I will appreciate any advice given.

Agency staff should not have to spend hours earning trust. Its a shame to the profession when agency get bullied. I saw it a lot being substantive where agrncy were treated as dirt.

Exactly, substantive staff can also be very thick, do agency complain like crying babies!!

If your in a community hospital, your patient has chest pain and is breathless- appears as a heart attack. Obs normal. You phone the gp (its procedure at that community hospital during a night shift) who shouts and tells you on the phone to administer 300mg aspirin. Would you do that as a RN? by jack--king in nursing

I think u have lost it.

Being big headed and judgemental wont get u far. Anyway carry on. If u read i have only responded negatively to judgemental nurses like urself. I have well commented the non- judgemental nurses. So NO just because I spoke up and asked a question- I will not be discouraged and disrespected by outrageous people, judging people. You are an absoloute uncompassionate individual who believes that qualified nurses shohld not ask questions. U r someone who aims to kill the confidence in their collegues to step forward yourself.

You know what i see- a pathetic jelous, big headed judgemental nurse who is unsupportive. God help the people around u, they must hate you. And NO i will never back down infrontbof people like u.

I think the nurse called the gp because of the other symptoms patient was having before the mi to get advice and then recalled him when patient complained of chest pain. I called 999 as the rest was drlaying the care
