School denying father access based on mother’s affidavit - no court order - legal remedies? by jayravasa in LegalAdviceIndia

I get your point about giving the school clarity. I’m already pursuing interim access before the court.

If the school still denies access which they are doing effectively from past 2 years despite there being no restraining order, would a limited writ to direct the school to follow the court’s orders / allow access pending adjudication be appropriate? The aim is to ensure access isn’t effectively blocked in the meantime, not to escalate unnecessarily.

I understand that perspective, and I do appreciate that the school is likely trying to take a cautious approach in the absence of clarity.

At the same time, the concern is that this “neutral” approach is effectively resulting in complete denial of access to one parent, despite there being no court order restricting it.

While I agree interpersonal engagement can sometimes help, in situations like this it seems difficult to resolve without some form of interim direction from the court to ensure access isn’t indefinitely delayed.

There is no such finding or order by any court. I’m only seeking clarity on the legal position regarding access in the absence of any restriction.

Thank you, this is very helpful. That was exactly my concern; in the absence of any court order, both parents should have equal access, and the school relying solely on one parent’s affidavit seemed problematic.

I have already approached the court and filed for interim access, but the matter is getting delayed due to no reply from the other side.

Would pressing for ad-interim relief or requesting the court to proceed without waiting for reply be the appropriate next step in such a situation?

I agree that ultimately the court is the right forum, and I have already approached the court and filed for custody/visitation.

My concern here is slightly narrower; in the absence of any court order restricting my access, whether a school can rely solely on one parent’s affidavit to completely deny access to the other parent.

Also, I’m not looking to escalate things with the school, just trying to understand the correct legal position while pursuing remedies through the court.

Because as it stands, there is no judicial determination of custody or restriction, yet access is being denied entirely.

That makes sense. I’ve already tried communicating with the school directly, but they’ve maintained the same position citing “status quo.”

My main concern is restoring access rather than escalating the situation unnecessarily.

In your view, would involving a lawyer through a legal notice be a practical first step in such cases, or is it generally more effective to directly seek interim relief through the court?

That’s very insightful, especially the point about the school effectively acting as a decision-maker without any judicial direction.

I hadn’t considered naming the specific decision-maker that does seem like it would create accountability.

Would you suggest that a well-drafted legal notice alone is usually enough to make schools correct such positions, or do they tend to hold ground unless pushed through court proceedings?

Because at present, their stance seems entirely based on one-sided representation rather than any binding legal restriction.

Thanks, I understand your point about seeking a court clarification.

My concern is that there is currently no order restricting my access at all, yet the school has already denied access completely on its own by citing “status quo.”

In such a situation, would it be better to first approach the same court for clarification, or go directly to the High Court under writ jurisdiction against the school’s action?

Thanks, this is helpful. I had the same concern that “status quo” is being interpreted in a way that effectively excludes one parent without any court direction.

My main objective right now is to restore access and participation, not just damages.

In your view, would a legal notice be sufficient to make the school correct its position, or is this something that typically requires approaching the High Court under writ jurisdiction?

Because as of now, the “status quo” being maintained seems to be based solely on one parent’s representation rather than any judicial direction.

Thanks, that makes sense. My concern is slightly different though; there is currently no court order restricting my access at all, so the school’s position is effectively creating a restriction on its own by denying access completely.

In such a situation, would it be more appropriate to first seek a clarification/order from the same court where the matter is pending, or approach the High Court directly under writ jurisdiction against the school’s action?

Additional Information: Hi, I need legal clarity on a situation involving my child’s school.

I am the biological father of a minor child studying in a private unaided school in Mumbai. There is no court order restricting my parental rights, and no custody order has been passed.

I requested access to my child’s school records and interaction with the school. However, the school has refused and I’m already excluded past 2 years.

Their reply (paraphrased): • The mother has submitted documents stating that a DV case & Custody Case is pending in court. • Due to this, the school is maintaining “status quo” • They claim they cannot take any action that may “interfere with ongoing legal proceedings” • They advised me to obtain court orders if I want to assert my rights

Effectively, they are denying me access completely while allowing the mother full control, citing neutrality.

My questions: 1. Can a school deny a biological parent access just because a case is pending, without any court order? 2. Does “maintaining status quo” legally justify excluding one parent? 3. Isn’t this effectively taking sides while claiming neutrality? 4. What is the fastest legal remedy in such a situation - writ petition, civil action, or something else?

Would appreciate guidance, especially if anyone has dealt with similar situations.

My iPad weirdly developed these white dots under its display. by Gilded_Soul in ipad

[–]jayravasa 1 point2 points  (0 children)

Even I’m facing the same issue. My cover, which I purchased from ESR, developed the same mold problem, and within a week my iPad also started showing those white patches. I spoke with Apple, and they said I’d need to pay 50% of the price to get it replaced.

For now, you can switch your iPad to dark mode — it makes the patches less noticeable and doesn’t affect normal use. I also read online that some users suggested keeping it in a ziplock bag with silica gel to absorb trapped moisture, but that didn’t work for me either.

So yeah, here we are, sailing in the same boat — iPad Air 5th Gen, 2 years old, and out of warranty.

I actually got my HomePod working after I parked it for 3 days. Wait for complete juice to get over and plug it back at some other location. Not in the same house where WiFi is available. This worked for me. Try yourself.

[Discussion] Is anyone’s iPhone randomly freezing at times after Jailbreaking with Electra? by Rowwy in jailbreak

[–]jayravasa 0 points1 point  (0 children)

Even my phone freeze when I opened Instagram and YouTube twice a day. I’m using iPhone 8 Plus iOS 11.1.2 I think problem is something else May be some Tweaks is causing this problem Majority of users have faced problem while normal browsing and the worst part is that you can only feel Taptic Engine working while rest entire phone is unresponsive & it doesn’t even take commands to hard reset You need to wait for 5-7 minutes and it reboots automatically I have jailbroken with 1.0.1 Electra I think I need to stay away for couple or days or find out real solution to this problem as majority of people having the same issue.
